Tribunal hearing coming up

I have a final tribunal hearing coming up in a few days,background to the appeal is this
2000 applied to CSA for maintanence.
ex is self employed builder refused to co operate with the csa
2002 maintance assesed at £84.04 per week
ex applied for reassessment in 2004
claiming no longer in receipt of income or benefitscsa reassed him with a nil assessment !!:mad:
I disputed assessment as know his history of working cash in hand and he actually got his father to phone me asking for me to call off the csa and said he would go unemployed and pay me direct- refused as been down that route before and he changed his mind after I had called off the CSA
long winded appeal final hearing held aug 2006. i won !!:rotfl: ex assessed as eariong £25,000 per annum
he did not turn up for the hearing, his partner did although arrived late, he asked for a setting aside claiming he was sent the wrong time , appeal was set aside.
we have had submission documents from him, he and partner sold both their houses 2003/2004 and purchased a house, since "not working" he claims to be working on the new property (now 3.5 years) adding 3 bedrooms, double gargage, garden room, 50' outhouse etc ect,he has opened a trade account with b&q , he declared one bank account as his only account all thru the first hearing, only a few weeks ago he has declared a joint account as well, listed on this account is another 2 undeclared savings accounts with many transfers to and from the joint account (and we are talking thousands!) I have prepared my final submissions to the tribunal, pointing out all the evidence that points to excess income over and above the proceeds from the sale of his property, i have today also written a letter that covers the childrens act 2000 which says that if someone has deliberately reduced their income to avoid paying cm they can still be assessed as having an income.

if anyone has any other information I can use on the day or any advice please let me know..thanks

    Does he have a mortgage on the new property?

    Yes he does for 240,000 ,she sold hers nov 2003.and used all the profit from the house to put towards new house, purchased nov 2003, he sold his feb 2004, the new mortgage in joint names, he had £83,000 from sell of his house, says gave her 47,000 plus 25,000 as his share in new property, but this money not in her ac, some (25,000) went into joint ac,he says he has stopped working as of dec 2003, 3 days after buying new house !!, CSA have no record of him advising them he wasnt working until july 04, from which the nil assessment is dated.

    I presume you have the Land Registry docs to prove the purchase price and what was paid to where? They can direct that he supply a copy of his mortgage application which proves how much he told the mortgage company he earned at the time of the application which is likely to cover at least a year, maybe up to 3 yrs accounts? Have the CSA contacted the Inland Revenue for more up to date accounts to check that what he says at least adds up with the IR?

    Yes we have a copy of his mortgage application on which he states he was self employed builder earning £23,000 per annum , we have his tax returns for the year before and after claiming £7/£8,000 per annum, the tribunal requested these. his argument is he purchased the house 1 month prior to going "unemployed".
