Student Loans Company Help!!

I am currently on a debt management plan with the CCCS (Consumer Credit Counselling Service) to pay off various debts. (Started at nearly 30K, now down to 6.5K!!!).
All of my creditors, apart from the Student Loans Comapny (SLC) have been relatively hassle free.

At the end of last year i contacted the SLC to update my outstanding balance which I was assured was the total amount outstanding.

Early this year i contacted the SLC again for an update only to find that my debt had GROWN by over £1000.00 as the person I spoke to before negelcted to tell me about the arrears to my account. On further digging into this, i found out that from the monthly deposit i pay to the SLC via the CCCS they were applying arrears to my debt every month. So in effect my debt wasnt decreasing by the amount that the SLC had agreed to accept.

Recently on talking to the SLC i have been told that the loan has matured and that the arrears have been combined into the loan. I received no written notification of this and if i hadnt contacted them i would have never known.

I have been on my debt management plan for over 4 years. All my other creditors accepted the CCCS and the role they have played in my debt management plan. However, not only do the SLC appear not to have accepted (at this late stage, and contrary to previous indications) the amount I pay back to them each month, but when the CCCS write to them on my behalf they never respond. And they are the only ones who phone me regularly asking for money. The reality is that I pay back an amount to them each month, which I can afford and which was agreed on my behalf via the CCCS. I can't afford to pay them back any more, but they still keep phoning.

Has anyone else had any similar experience or can offer advice?? I am approaching my wits end with them.

    Dear sir/madam

    With reference to the above account, I am writing to confirm I am not acknowledging this debt.would you please send me a true copy of this credit agreement. I understand that under the Consumer Credit Act 1974 (Sections 77−79), I am entitled to receive a copy of my credit agreement on request and this should be supplied within 12 working days. I enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

    Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.

    As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.
    Please note that under Section 189 you are obliged to supply these documents whether you are the original creditor or not. I await your reply.

    If they are being pig headed then send them the above letter adopt it to your needs and then sit back. If they have a signed credit agreement fine they can chase you. If they have not then you can tell them where to go and F jump !!!!

    Bailiffchaser, I don't know if that would apply to the student loans company as it is not consumer credit, it is a government loan to fund education.

    Captainbeaky, I can't offer you any advice I'm afraid. best to talk to the CCCS about the situation as they will probably have dealt with the SLC before.

    Just wanted to check you are making enough money to be required to pay off your student loan. It's around £2,000 p/m at the moment. All you have to do is send them 3 months payslips and they put it on hold for a year.

    I've been deferring mine for years and plan to tackle it once everything else is out of the way.

    Best of luck in dealing with them.

  • Thanks all for the advice, (un)fortunately i earn over the deferrment limit so that is not an option. Guess i will keep having to banging my head against their brick wall of nonsense.....
