Current Employer Requesting Details of Termination from 2nd job

Was pointed in this direction from the CAB forum..

My Step father had 2 jobs up to last month, they were both working for 3 days a week. He got fired from one, because he forgot to wear his ear protectors (hardly anyone wore them so it was too easy for him to also not wear them). He mentioned this to the employer at his other job and they have asked him to provide written details, meetings minutes, letter of dismissal etc.. does he have to provide them? and what if any, could the potential consequences be if he does? or if he refuses?

Thank you
Lucy

  • Why do they want these details? Has he asked?

They've no right to ask for it. Are they similar jobs? If he's required to wear safety gear in one job, and got sacked in the second job for failing to wear safety gear, the employer of the first job probably just wants to make sure the employee is not a danger to anyone.

Indeed: what have meeting minutes got to do with the second employer?

The most I can see they require is a note from their own employee (the OP's stepfather) advising them that they are now his only employer. The reason why they are doesn't need to be given to them.

They probably should be told of no longer working for the other employer so that they do not have to consider those hours in relation to the 48-hour maximum working week or similar H&S considerations.

If it were about a split tax code, then it just requires HMRC to be advised to assign all of the tax-free allowance to this remaining employment. The employer would not need to know why the code had changed.

He doesn't belong to a union. He didn't think to ask 'Why' they wanted this information.

The other job was cutting wood for a DIY change store.. which required eye protection and eye protection.. he knows he was in the wrong for not wearing, so not disputing that..

This job, he is testing electric equipment for a charity to make sure suitable for re-sale. No protective clothing required in this job.

Maybe they want to help him with a claim for unfair dismisal.

Tell them this is confidential information and you can't disclose it.

We are afraid they want to use this information as an excuse to get rid of him.. so really wanted to know, if they can legally ask for this information.. and if he's allowed to say NO, a suggestion on how to say NO without that being a reason for them to use to terminate his contract.

I would just let it go and if he gets asked again, ask why they need it.
How long has he been in this [current] job?

They told him on Thursday to bring it in Tuesday this week, which is his next rota'd day. He's worked for them for a couple of years now.

Probably making a permanent record of his none-use of personal protection gear to make sure any future claim is dismissed.

It's not illegal to ask for information but they have no legal right to insist they receive it.

Though there was no need for him to have said why he wasn't working for the other employer any longer, how did he phrase telling them? What level of person is asking to see the documents?
