CSA Incompetance.... (amazing...) they want to set up a direct debit?

Options
OK... After checking my bank, it appears that my letter to head office where i work made them pay all my holiday pay... so today i paid my csa (as normal not late etc and it never gets to PWC until monday - despite faster payments)

i wont qualify for Income support this week, or i presume next week either, as my earnings are about my average weekly amount due to holiday pay being paid. so im cool with that...

but: i got a call just... on the 8th of november my ex (PWC) said she wanted payment to be via them... on the 9th maintenance direct was set up....

since the 9th, ive paid all my money due, plus the "arrears" down to 30 quid by my calculations...

however: the guy from CSA said that they are obtaining a DEO because this is what the PWC wants. so i said i would pay by debit card over the phone, or set up a standing order...

this is not acceptable to the CSA? my problem is: the date she asked for a them to obtain a DEO (which she cant request since im paying? - but can ask to go via the CSA)

any way: the csa have said all payments via maintenance direct are between the PWC and NRP - no debt is acrued and no debt can be cleared... i should of been sending my additional payments for the debt via the csa... !!!!!!? why do they not make this clear? - although, it is classed as a "CSA CASE" since the 8th of november... it turns out she has been saying i havent paid anything... despite my bank statements saying otherwise.

so here we go... the CSA as a weapon against the NRP...?

i asked the advisor to check what my balance was, and he said it was £164 in debt... which seems to be the original debt - but they had to assess what i owed since the 8th of november, as this wasnt on a payment schedule, then they would not be able to tell me the debt...

so i asked the clearer question:

OK from the XXX of XXX when my case was opened with you, my assessment has been... what should i have paid since then?

he couldnt answer this question. as during the maintenance direct they couldnt enforce payments... but payments made could be treated as payments from this period... so its down to a decision maker to sort out what i owe?

my god, so i then realised... hang on why has it taken a month to get in touch with me about this? - ive actually spoken to you before about this...

my ex apparently called up last week to say i hadnt paid anything since september... !!!!!!? so considering i have my payments marked as "CSA PAYMENTS" on my bank statement, this isnt proof - despite me having a letter from csa to say this is how i should mark them...

and i am left with a debt?

i really do think i will be better to pay direct to the CSA now... as PWC is being such an egit...

they are calling her up... to "check if she wants maintenance direct or them to collect" but either way im liable to payments since 8th november AGAIN if she stands by the fact the payments werent made, despite me marking them as such?

to think, im going to have over 17 years of this still, perhaps another 25/30/50 if the gov decide i need to support my children further etc... WTH is with this lot?

Tbh if I was you I would write to the csa saying that from now on you want to pay all maintenance to the pwc through them. This will mean that your ex cant say shes not been paid and then make everything confused like what has happened now.

I would write to them and tell them to clarify exactly what they believe is owed by you in writing. Do not talk to the csa on the telephone always deal with them in writing. If they think that you still owe arrears youve paid directly to your ex then send them copies of your bank statements showing the payments.

On a side note you seem very angry with it all, you need to calm down a little and realise that this is part of your life now. As long as you can prove you've paid, continue to pay and keep the csa informed of any changes in your income you shouldnt have many problems with the csa (famous last words huh?)

Well, following on.. CSA applied a DEO... my income being SSP... they calculated it at my maintainance being £28 /. week... letters etc sent off...

I'm still on a deo, got a £50 compensation check from them... no payments have been taken by DEO (although money is going to savings acc)... and they INCREASED my "protected income" from £191/fortnight to £254/fortnight.

quite amazing really... considering during the whole process my payments (since jan) has remained at £28.

(which means they calc my income at £186 (obviously AFTER the 20% reduction for my 2 kids that live at home with me)...

CTC is only £74, and my SSP has been "intermittant"... (the average so far is £40ish/week - apparently my drs "Fit Notes" werent sufficient evidence of inability to work. since they state "amended duties" - which employer wont supply.)

but even lets do some math...

    £74 CTC, £85 SSP = £159/week income... (so that means: £5 + 19% of £59) = £16 liability...

despite the compo check, and letter agreeing they have got it wrong... still no reassessment.

my MP has written for them to correct it... still nothing...

but they havent deducted any money from my wages as they havent issued a new DEO...

I even included in my letter to them my bank details for a direct debit to be set up... and outlined the fact that i attempted to set up both a CC payment with them on the phone and asked for SO details...

but as you said i gave up with it... and its a lot less stressful.

my ex has had no maintenance (not by my choice - by hers). I have sent her a copy of the letter from CSA outlining that they understand the DEO will be ineffective. Asked her to be a responsible adult and go back to payments directly... and she refused to... so I've left it with the CSA (obviously with the money what I know I owe going into a bank)... - note: the £16 is on full SSP - not on what I actually recieve...
(and yes... i am well aware of an acruing debt - hence money going into a bank).
