Advice on counter notice letter

Having been made redundant a few weeks ago I've managed to secure a new job. They want me to start before my notice period would have ended so I'm intending to issue counter-notice to my existing employer. Could someone please advise if the letter below is correct?

Also, is it worth asking if the employer would consider making a payment equivalent to the notice pay I would have got if I'd worked my full notice? In other words, pay me to 5th Feb rather than just 31st Dec. I've been here 15 years and I believe my contribution was valued so hopefully I'd get a sympathetic hearing, but I don't know if it is the 'done' thing to ask this or not! If so, please advise if what I've put is the best way to ask this.

Following on from a meeting held between myself, xxx and yyy on 13th November at which I was informed my position was being made redundant, please accept this letter as written counter-notice to leave early, as per Section 136(3) of the Employment Rights Act, 1996.


I am proposing a finishing date of December 31st, as this will allow time for all outstanding matters to be dealt with.


Please confirm you accept this as my date of dismissal.


Please also confirm the amount of redundancy to be paid and advise whether the company would consider a payment corresponding to the initial notice period as a gesture of good will and in recognition of my long service.

    Sounds fair enough to me but I'd change the word "dismissal" to termination; and not hold my breath on them giving you the rest of your notice pay.

    Is there any sign that there will be no work after NY so there is no point in them keeping you and they might as well PILON. would that be worth asking for.

    Might be you are happy to get out with the small loss of pay.

    Bringing the date forward should not effect the statutory redundancy payment(due to statutory notice) but if the start date was inbetween the two dates watch out if they try to take a year off.

    This must be worth a try - the end of the year is a logical break point.

    Just say that you would like to leave at the end of the year so that you can concentrate on looking for a new job in the new year etc. etc. (you will of course ensure that all work is up to date and complete etc).

    If you get no joy on that one, then go for the counter notice.

    When does the new employer want you to start ?

    In the meantime, please do not mention the job offer to your colleagues or put anything on facebook etc !
  • Trouble is they know about the new job - I've had to have time off for interviews etc.

    In some ways I'm surprised they made me work my notice anyway, my leaving was a bit of internal politics, future owner trying to assert authority over their father. They have decided to stop developing new products so no call for a design engineer!

    Nothing much to do other than sorting out a few procedures in the hope they can manage when I leave on the areas were at the moment I'm the only one in the company who has a clue.
