  • Rog2, i did not say it was fair to your wife. You asked if the Trustee can force a sale and i said yes they can. It is unfair in your wife, but the law puts the creditors interests above hers.
    In reply to your last post 1. the low cost conveyancing scheme is only for where the OR is disposing of an interest in a property, so no it will not be available to you. But the Trustee may have a similar scheme. 2. I do not know, sorry. If you have a financial association (any joint debt, loan etc) her credit rating may be affected by your bankruptcy so yes possible she wil be offered highrer rate of interest.

    My actual question was 'why should my wife suffer for something over which she had no control?' It was NOT a dig at your post, merely a question, which must have been asked many times before, and I was genuinely looking for legal clarification.

    Thanks - I will write to the trustee, to ask. I WAS assured,in answer to my specific question, at my OR meeting that the appointment of a trustee would not affect the way in which my case, or indeed I, would be treated. I will mention this in my letter.

    Hi rog.I know we are of a similar age and although I never went bankrupt I lost a good deal of money when I had to close my business some years ago.I just want to wish you all the very best in sorting out this problem.

    To everyone else - I still need your continued advice, which, thusfar, has been of great help and encouragement.
