  • Hi,

I recently sent a letter to a debt recovery agency stating that the debt was statue barred. I received a letter back from them saying that this debt would no longer be persued by them, they have since sold the debt onto another agency who have now written to me asking for payment.

Please could you advise me what to do next.

you will need to send the statute barred letter to that agency as well.

  • Hi. I have quite a bit of debt, it accumulated when I lost my job in 2000 and had to default on loans etc. Long story short, had a nervous breakdown, been on benefits up til last year. Was considering bankruptcy at time but citizen's advice said no, just hold on and in 5 years with no contact debts will be written off. I'm fairly certain last time I would have had any contact with any company would have been 2001.

I've now been working 18 months, and jusy got a letter from a Thames Credit. It said I owed them from a bought debt, gave a reference number and a phone number, nothing else. So I had no idea who it was in relation to. I phoned them to find out. Have spoken to a guy who says I owe £400ish to GE Capital bank from a New Look store card. Now, this is my question, he asked if I recognised that and I said yes, he asked if I had lived at a particular address, I said yes. Have I acknowledged the debt? I presume they tape phone calls and can prove I said 'yes that's me' or whatever?! Can I still send the 'statute barred' letter? My debt is rather huge and I really didn't think it would catch up with me. Like a previous poster, I recently had a credit check done for a new bank account and the only thing showing up was an 'unamed utility bill' for approx £100, which I'd happily pay off if I knew who it was I owed!

The guy at the debt collector said if I pay the debt in one go they'll reduce it to £288, should I just pay it or tell them to get stuffed? Also, I've moved about 4 times in intervening years, and stayed off voters roll. I re-registered on it about 2 months ago, and the letter from Thames Credit says they used 'public records' to locate me, I presume they mean voters roll?!

Lynnski - acknowledgement has to be in writing or by making a payment.

Why don't you start a new thread?
  • Fatbelly, cheers. I won't start another thread as you've answered my question. Thanks so much!!:T

I am in a similar situation now as you were when you made your post and I am wondering.... what happened in the end? If you are still around please let me know how you got on after sending your letter.
    Many Thanks.
