Letter to Creditors

I'm No. 384 DFW and I have several financial problems. First of all I am just starting to have real financial difficulties. My mortgage and most of credit card bills are up to date but I won't be able to pay my cc's and my mortgage any longer so am opting to pay my mortgage which is £1,200 per month. My husband and I have £50,000 in credit cards and loans. We have a business which will either sink or swim in the next 3-6 months. Things are actually looking up in business but we need to get through the next 6 months.

Would like some advice on how to get through the next months without all those horrible phone calls from creditors.

I will be doing my SOA this weekend.

    2. Do a SOA. Post it.

    3. Get in contact with one of the debt charities

    Dear sir/madam

    With reference to the above account, I am writing to confirm I am not acknowledging this debt.would you please send me a true copy of this credit agreement. I understand that under the Consumer Credit Act 1974 (Sections 77−79), I am entitled to receive a copy of my credit agreement on request and this should be supplied within 12 working days. I enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

    Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.

    As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.
    Please note that under Section 189 you are obliged to supply these documents whether you are the original creditor or not. I await your reply.

    Send this to everybody you money to and see if they have a credit agreement. If one does not exist then the debt cannot be enforced.
