in debt with paypal

hi this is my first post in these forums so please be gentle if this is a small problem but im after a bit advise if anyone can help.

last year i sold a xbox 360 on ebay and recieved the payment through paypal transaction went through no problems.
since then i havent used my paypal account or ebay account then early this year (approx 6 months later) i had a email from paypal saying that my account balance was negative due to a charge back from the buyers card company as the card had been used without there knowledge for the purchase. i followed paypals procedure for settling the dispute and my account remained in negative balence while this was happening.

today i had a call form interim justica (debt collectors i believe) saying that they needed payment as paypal were ready to take thing further to recover the debt.
i understand that paypal want there money back but if i pay them the outstanding balance of £239 then im out of pocket by this amount and without the xbox which was sent to the buyer as there was no problem at the time. i thought that paypal took a percentage of the money you recieve as payment for processing the card and checking for problems like this.

so if anyone could shed any light on this situation and where i stand with regard to paying them back (which i cant afford in one go) i would be most greatful as it seems most unfair that i should be out of pocket by £239 and a xobx 360 when i did everything right.

    Did you contact Ebay about this? At surely the issue with them as the buyer should have returned the Xbox - it sounds a bit dodgy on their end to me. If the card was used without their use, then why did they keep the Xbox, it wasn't free.

  • ebay says the buyer is no longer registered with them but ue without consent could mean the card was stolen in which case there was no chance of getting the xbox back.

    I assume you have the address where you sent the xbox - maybe you should inform the police?

    I cannot believe that Paypal are trying to make you pay this.... it's Ludicrous.

    Have you spoken to Paypal them selves about this?

    Also contact everyone you can tyhink of - CAB, Office of Fair Trading, The Paypal regulators, even the Police if you think it would help.

    The cost of writing a few letter and making a few calls is nothing to the £239 you stand to lose.

    Afraid there isn't much you can do - this happens alot with paypal - there is no protection at all for the unsuspecting seller - the details of where you sent it to should still be in your paypal account however - you need to select the advanced search and all transactions to pull the details - having been bitten myself a couple of times myself I avoid paypal as a seller - it is far too risky - I believe there is a paypal/ebay board on this site - someone there may be able to help you further

    It happened to me as well. Sold a phone for about £250 quite a while ago...stupidly hit the 'withdraw' button on the Paypal account before noticing that the person sending me the money was certainly not the person who'd bought the damn thing.

    After ages in dispute, nothing happened at all - It was an overseas shipping as well, and PP decided that the method I used to post out (the one actually recommended by Post Office!) wasn't good enough.

    One of those things you live and learn from unfortunately.

    The good thing is that now I am so savvy when it comes to ebay now - I've completely rejected people, emailed eBay about people - everything! I'm not gonna lose any more money.

    I sympathise a great deal with you, but I very much doubt you'll get that money bad (especially after 6 months)...

    This is exactly why I only use paypal to buy things (and get buyer protection) but never accept it when I'm selling items. They have absolutely no incentive to get this sorted and they will just go for the easiest target...you!

    p.s Having now given this some thought. Paypal should not have refunded the money to the purchaser. If their card was used fraudulently the card holder should speak to the card operator and the police.

    Put it this way. If somebody used your card in a shop without your permission, would you go to the shop (without the goods) and expect a refund? No of course not you would speak to your card provider and the police. I would complain bitterly to Paypal for making an inappropriate refund when the purchaser still has the goods and you can have no influence on who uses the credit card. Paypal accepted the card not you, it's their responsibility.
