A friend of mine has split up with his partner, his morgage and also a loan are in joint names. The problem is that the partner has left and cannot be located, will not answer phone call, text message or emails.
He has been told by both Morgage company and loan company that he cannot take control of them until his partner signs documents.
Please can you tell me what he can do, as this is obviously affecting his credit rateing because she has failed to unhold the agreement of paying her half of the debts. He has continued to pay his agreed 50%.

    It doesnt work like that.

If she isnt paying hr half then he has to pay all of it. If he doesnt it will get to the point of reposession.

Made me laugh a bit that you edited this for "spelling mistake" would have hated to see the pre-edited version...

Sorry, onto the sensible question. There is not much really to be done, apart from contact the other person (The Ex)

Your friend either pays it all, or goes into arrears and affects their credit ratings. Sorry, the mortgage is joint and therefore the liability is joint.

It would be incredibly costly to go through a Solicitor and try to get this done in lieu of them being present and likely he/she will turn up at the end of the process in any case.

With Social Media, the internet and assuming that he knows some of her family then she cannot stay hidden forever...

  • Thanks for the reply and sarcasm.

He wants to sell the house as a result, but he cannot contact his ex, how does he go about this then?

He needs to obtain a Court Order which will give him the legal right to sell the property.

Independent legal advice is required here.

    He simply cannot.

He will have to go through the full legal system in order to achieve this and that will take months, if not years.

Sorry, no quick solution I am afraid.
