OP, the disciplinary hearing was your opportunity to state your case - that is to say your version of events.
If you were aware that there were other members of staff who would state that you were not guilty of the conduct complained of, did you name those people and ask the employer to interview them? If so, are you saying that the employer refused to speak to those people? Or that those people did not speak up for you? Or that you did not raise this point at the disciplinary interview?
My point is, that even if it was your understanding that you were not allowed to speak to these colleagues in order to prepare your case, it seems reasonable to assume that you would, at the very least, have raised the fact that these people had evidence that would clear your name, with your employer?
Of course your problem is that even if what you say is right, they may be concerned for their own jobs and not want to get involved. They may even not say what you think they should be saying (one of the problems in calling a witness when you don't know what they are going to say). In that case, you are up a creek.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -

I did tell my employer in my meetings that there were people that could confirm my version of events and when i was dismissed I asked why they did not speak with these people and they said I would need to bring this up at an appeal.
Secondly I did ask if I cold bring witness's to my interview and they refused to answer this question which I did pose to them they brushed over and started talking about other things.
Thirdly can anyone help me on the point that this has supposedly been sent to a competitor yet there is no record or proof of this happening so how can they be accusing me of this when nobody has mentioned this in any statements?
Thank you all....I am currently speaking to (ex) colleagues.0 -
Hopefully you've already put in for an appeal. Presumably it was 5 working days you had to appeal and not 5 calendar days??Saving money right, left and centre0
