Sent off a 4 page letter of appeal today. In this I asked for a complete account breakdown and proof that partners ex requested review back in June 05. If they can't provide it I don't see why we have to pay it, if they can provide it I will put in a claim for maladministration to the Chief Executive of the CSA for their incompetence. Also asked for the arrestment of wages to be revoked as partner has NEVER missed a payment, even before CSA got involved, so don't know why it is in place. They also charge us 50p a month for this privilage, not a lot I hear you say but better off in our pocket than theirs!!
Just have to wait now with everything crossed :eek: !!!!!!!!I can only please one person per day.Today is not your day.Tomorrow doesn't look too good either.0 -

Departure is old word for variation! It means the same thing but Departures vary slightly.0

Had a telephone call today from CSA saying they had looked at my partners variation allowance claim and it has been refused. I asked on what grounds and was informed that because he agreed to take on the matrimonial debt in the divorce then basically he has no claim. Does this sound right? Also for such a simple decision they took over 3 years to come to this conclusion, they had all the information available to them right from the beginning, surely if it was that cut and dry they could've told us this within weeks of being submitted. What exactly have they been doing all this time? :mad:

How unfair is this system? I will not give up fighting for my partner.
His ex has done some really nasty things to us since we have been together, she moved house when there was a visit scheduled and didn't bother to tell us and when we confronted her she responded with "didn't the for sale sign give it away?" and she also got her now husband to come outside one day when my partner was dropping the kids back home and he hurled abuse saying "so you think ****** is your kid do you, well think again" (her now-husband was her boyfriend immediately prior to her falling pregnant and marrying my partner). We told the CSA about this and they said they would write and ask who the father was! She said it was my partner! We thought about DNA test but couldn't afford it. This is just a couple of things she has done, I could write a book about her evil sadistic ways!!!
I will fight the CSA tooth and nail over this.

You can appeal against the Departure decision, whereby a Tribunal will ask more in depth questions. You have nothing to lose. He should argue that whilst he agreed to take on the debt, some of it could still be allowed under CSA legislation - although some must be ignored. What things does theh PWC still have the benefit of, but he has the liability for? Was any of it in his name but she is still having the use of?0

I don't think she has anything left from their relationship because she moved in with her now husband, he already had a home set up and they have since moved. She wouldn't let my partner get any of his belongings after he left, he walked out of the matrimonial home with just 2 bags of clothes and an ornament given to him from a previous job, we were told by the kids not long after they parted that she had sold alot of his things - bike etc and thrown the rest out.I can only please one person per day.Today is not your day.Tomorrow doesn't look too good either.0
