    And as always there is only one winner whichever way the case and location and ability to recover the assets turns out.

    That's my understanding yes (unless you pay off the fine or successfully have the confiscation order overturned).

    I'm not sure an indefinite prison sentence means you are a winner. It's also worth noting that once the assets are frozen the criminal cannot access them so even if they were released for some reason they don't get their hands back on the money.

    that is not the issue - that is an issue with getting a confiscation order in the first place. the court will only impose a confiscation order for £X if the prosecution can prove to the court that the guilty party:

    I agree its not issue. I was just pointing out that the poster I was commenting on had misconstrued the situation. He was talking as if they were on trial whereas they were convicted!:)

    Why does this only apply to rich people?

    If I refuse to pay a £25 parking fine can I be kept in prison for the rest of my life?
    Wouldn't prisons be full up with lunatic obstinate old pensioners?

    I dare say that if someone wanted to do this they could but in this day and age a Government realises that it would be impossible to do in practice if it were costing £1K a day or whatever it costs to keep you in prison.
