Hi i'm new to this forum so sorry if this is in the wrong bit.
Recently my partner has been getting letters from debt collectors saying he owes money. This is worrying me sick!
So far he has received letters for 3 different debts.
DEBT 1... £495.13
Is a letter from Hamptons Legal stating that he has not arranged payment despite previous letters (he's not received any). That as previously advised they have assessed his financial means and will look to the courts if necessary to ensure this debt is repaid and they can nowapply to the courts for a CCJ which they could have enforced by applying to instruct bailiffs to remove goods from the home, take money direct from his earnings or money straight from his bank.
The letter goes on to say to avoid action partner can pay a discounted amount
This debt nor the original one (T mobile) show up on his Noodle credit file. (unsure how reliable credit files are as i've never had to use one before)
DEBT 2... £2.278.12
He's received 2 letters from Lowell Financial. The first 10.10.12 saying they have written several times before blah blah (not received anything before) the second 22.10 basically saying 'make us an offer' If he didn't they would pass it on to RED, their collection agency.
He's now received a letter from RED saying they now have a copy of his credit file and have assessed they best way to recover the money and a passing the account onto Hamptons Legal unless he pays. again there is an offer of a discounted rate.
This debt (to Lowell is on his credit file with a default date of 11.2007 When I checked earlier in the month it was also on his file under the original lender (Lloyds) with a default date of 02.2007 that entry has since gone from his file.

Received 2 letters from Clarity. The first a make me an offer letter Original lender MBNA. Clarity's client Arrow global.
The second stating the Arrow global have advised them they can now accept a reduced settlement.
This debt shows on his credit file under Arrow Global with a default date of 04.2007. There is no entry from the original lender.
I am worried sick about this. I own my own home and am the only one working in the house hold. My partner owns nothing other then the clothes he came in. He doesn't even claim unemployment benefit. We have a joint child/working tax credit claim and i'm worried his debts are going to have to be paid from that. We barely have enough to live on as it is. On top of that I bought a car earlier this year (after 2 years of saving) to help get my autistic son around as he has constant meltdowns on public transport. As I don't drive I registered the car in my partners name. It's only worth £700 but if they took this it would take years of saving to get another. Can they take it?
Sorry this is a little long winded. Please advice as I can't sleep with worry at the moment.

put the car your name asap
If it gets as far as bailiffs
you go to a solicitor and get a statutory declaration done cost £5/10 get 1 original copy and 3/4 notarised copy's
then if a bailiff turns up to levy goods do not let him in under any circumstances you hand him a photo copy (through the letterbox) of the original stat dec send a notarised copy (registered post) to the creditor and a photo copy to the bailiff company (registered post)
Ive got a template stat dec somewhere on my lappy will post it up when i find it you can then amend it for your circumstancesI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

Sista He moved into my home with just a bag of clothes and doesn't work. I support him. The house and everything in it is mine.
I was told that the owner of the car does not have to be the registered keeper.
Partner thinks these debts are statute barred.
What is a statutory declaration?

My son is autistic and it is very difficult if we both work. Someone is often needed in the home to care for him.0

Ok, please don't take these questions the wrong way, i'm just trying to get the situation right in my head so we can see the full picture
How old is your son?
Is your partner the father? The reason i am asking this is not to be rude, but to ascertain how you managed before if he isn't. x
Are there any family members who can step in to look after your son if your partner goes out to work?
Can he work evening shifts somewhere when you get home form work?

He moved into my home with just a bag of clothes and doesn't work
A statutory declaration is a legal document you are saying under oath that everything in your home including your car belongs to you and were bought with your own funds 1) because he moved into your fully furnished house and brought nothing with him expect his personal property clothes 2) the car was bought by you from your wages and he did not contribute financially to its purchase
I done a stat dec for a Friend of my DIL last summer for the same reason her partner moved into her house with his clothes and nothing else he had bailiffs chasing him for a magistrate court fineI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

Do you work weekends? if not could he not get a weekend job somewhere? He has a long standing back injury from a car accident and has worked periodically but normally has to give up after a few weeks.
