advice needed

sorry if this has been asked a million times, i find all this confusing.

i was made bankrupt in scotland in june 2009 and discharged the following year. i`ve tried a couple times since then to get a high interest credit card to rebuild my credit and always been refused so came on here an seen about 'cleansing' the credit account. i`ve got my report from experian and there are still 3 companies who i`m down as owing that were in the bankruptcy details so obviously need to sort those out....i`ve also noticed it states on my credit report that i was only discharged from br in june this year :eek:

now i know i was discharge in 2010 as i got it all in writing BUT being young and stupid i lost all my bankruptcy details incl discharge while moving country :( is there any way to obtain a copy of these? i`ve tried searching the register of insolvencies online and where i used to be able to find my details i can`t anymore like it was never there :huh: so i don`t even have my case reference number. i`m sick to death of giving these debt collectors my br reference an cause it wasn`t through a court they`re unwilling to accept them!!

so i need to know how i`d go about getting a copy of my br order and discharge and also when writing the letters to the company do i send them to the debt collectors who`re harassing me or to the actual company who i had the debt with?

    You can get a discharge certificate from the Accountant in Bankruptcy 0300 200 2600. I think it costs 11 quid, but they can tell you exactly how much it is.

    It sounds like the credit reference agencies still think that Scottish bankrupts have to wait for three years to get discharged. That changed from 1 April 2008. You can point that out to them if you like ;)

    You can also point out to debt collection agencies that debtor applications/petitions for bankruptcy in Scotland don't go anywhere near the courts, and that maybe their organisations should sort out their training!
  • thankyou both :) i shall be contacting aib tomorrow but until then it`s driving me mad as to why i can`t find it on the insolvency register - tried under my name in all possible spelling even though i know the way it was spelled on the deed, my address and the dates but nothing is showing :huh:

    so who would i contact to inform them that on my credit file my bankruptcy dates are wrong? also is it the people i originally owed the money to it send the letter in order to cleanse my file or is it the people on my file aka arrow global?

  • weird! i found a saved copy of my extract from the register i had kept on my laptop, typed in the case number on the aib website and it`s showing up as 'no results' doesn`t seem possible, anyone know why it looks like my file has been wiped? gonna drive me nuts until tomorrow lol

    Hiya

    The Register of Insolvencies only shows 'live' bankruptcies and bankruptcies which have been discharged in the past two years (that means that the trustee has been discharged, as well as the individual).

    So, if you were discharged in 2010, chances are your trustee was discharged soon after; two years are up; so no more record on the Register :)

    HI Twixlet,

    Im getting discharged early month and im based in Scotland.I noticed my case reference numbers on both my experian and equifax credit report which i viewed online last week (Just below the address/es) and before the credit details...Maybe yours is different from mine..sorry there.

    My BR date and DB dates are showing as correct.

    What i used to do in the first few weeks after BR was send them my BR case number and whenever some of them were ignoring my letters which i sent via recorded delivery,i sent final letters stating that i'd progress with legal action if they keep harrassing you-and they stopped.

    I wish i could help you any further.
