Tsb loan

Hi,

I defaulted on a loan with these; I have agreed a settlement fig of £1200 saving £400 from £1600. I made the first payment in October and will make the payment for November on the 28th - 6 in total last being march 2013.

My question is if I raised a complaint on the default; if they get petty are they allowed to pass or sell the debt to a debt agency like Capquest etc? I was thinking being in the middle a settlement plan which I am adhering too then they maybe couldn't.

  • A lender can sell any debt they want. But they are unlikely to while payments are being received, unless they are looking to exit the market.

    On what basis do you think you can complain about the default?

    You started this post saying you defaulted on this loan. You're already getting off lightly, the rest of us repay everything we agreed to but now you feel you have grounds to complain?

    Did you get agreement to that settlement in writing?

    I wasnt notified in 2010 of a default; I agreed a plan and then I got letters of their solicitors letters advising of legal intent - this went to the ombudsman and I was successfully in getting their initial decision overturn. I am just looking at whether they should be sending proper letters on default instead of having letters sent on legal intent once you have already arranged a plan - surely they would have know about any default issue round the time of me arranging a plan.

    When you say "US" would that be the same people who get these IVS where they waiver all the interest which is something they agreed when signing any credit agreement. Yeah I pay all my debt as well and this time 3 yrs ago my debt stood at £9k now it stands at at £1k. What was that about the "rest of us paying everything agreed"!!!
