solicator leter after discarge

hi i hope someone can help i applied for bankruptcy back in june 2009 as i had a fire at my business in the feb 2009 and now i have had a letter from a solicitor saying i ow the land lord insurance company a considerable amount of money i had no insurance at that time to cover it but i av just had the letter 3 years later i was discharged in the june of 2010 can they do anything about this as the debt was not put in the bankruptcy as i didn't know about it ?

  • It does not matter whether the debt (liability) was included in your bankruptcy, what matters is when the liability arose.

    If the liability predates your bankruptcy it is automatically included, whether you knew about it or not. If the liability arose after the date of your bankruptcy then it is not included.

    Logically this date should be the date of the fire because that is the event which triggers the landlord’s insurance company’s claim.

    I’d write back to solicitor and tell them: as the fire on xx February 2009, which gives rise to your client’s claim, predates my bankruptcy on xx June 2009 (Case No XXX of ZZZZ) you should send your claim to the Official Receiver at abc address to be dealt with.
