Yes, the visa doesn't affect her residence for council tax purposes.
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
  • Thanks for your response, which i am a little surprised at since, she cannot work until granted further leave to remain in the UK, has no income or any entitlement to benefits.

If she is your partner in the sense that you live together as man and wife even though you are not married, then in CT law you and your partner are treated as if you were married.

This means that you are jointly and severally liable for CT, so if you didn't pay, did a runner and could not be traced, your partner would be pursued for the CT owed and vice versa.
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales
