BR and repossession

Hi all,

Haven't been on here for a while but now almost ready to file for BR - just swapped over accounts to basic ones etc..

We have 2 x empty properties with mortgage arrears and are receiving forwarded mail from just the one property that we used to live in.

Today we have had a letter to say that there will be a court hearing on 3rd Jan and there is a form to complete.. and court fees of £100 each I think..


We are now in rented property so have no plans to try to move back in there.

My questions are;

1. Do we have to complete this claim form
2. Do we have to attend court
3. Do I put Court fees on BR form


Any advice would be great.

Not sure what will happen with other property as we are not getting any mail from there..

1) No. In fact, don't. Send a letter separately saying you have no objection to the reposession, you don't want to be trapped into taken on any responsibility for any shortfall that would otherwise be included in any BR.

3) Can do if you are liable for the fees prior to BR which if you have been billed for it already it would seem you are.
