ok so worked for a company which consistantly paid me late.
So left last month because of the above giving my four weeks notice. however I left before the pay date.
I received my payslip but no pay.
Email and phoned and they sed we havent recived payment from our client so we can only pay you 100. we will pay next week.
waited a week and same story we cant pay.Attutude now is you are low priority becasue youve left and theres no money to pay you so its tough.
What are my rights?? Is best course of action to do a MoneyClaim online??
Any Advice??
Thanks in advance

You could do but you would be better to make an employment tribunal claim.
First send a letter before action setting out what you are owed and giving a short but reasonable time in which to pay.
Assuming they don't file an ET claim (you can do it online). Unlike the small claims court there is no fee to pay.
You MUST lodge the ET claim within three months of leaving so don't be strung along.
One advantage of using this route, if you end up having to take enforcement action, is that you have cheap access to the High Court enforcement procedures rather than having to rely on bailiffs.0 -
ok will look into that, does this take longer compared to the MCOL whats the difference?0

It could do but it could also be quicker.
With an ET claim, ACAS will become involved in an attempt to sort it out before tribunal. If it is clear cut they will basically tell the employers not to be so stupid and pay up. This will at least show the employer you are serious.
If they really drag it out the enforcement procedures are far better.0 -
Ok thanks, will look into this today..0
