Cpquest changed the default date - please help...

Im really hoping someone can offer me some advice. Around 5-6 years ago my relationship with my partner broke down and I was left in lots of debt. I ended up with 3 ccjs/defaults. 2 for store cards that I got for my partner and one mobile phone bill that again was his but in my name (Silly I know and believe me ive learnt me lesson!) I have spent years getting back on my feet and have paid off all of ‘our’ joint debts and all of the debts I had run up. I refused to pay the 3 mentioned above, however in hindsight I would have due to the trouble they have caused me over the past few years.
However, these are now 5-6 years old but ive looked at my Experian report recently and have noticed that Capquest have taken over the phone bill default, but they have changed the default date! Moving it from being 5 years old to only 2. This now is affecting my ability to get credit – I only noticed this as I applied for a normal current account and was refused! I have a copy of my report from 2009 which luckily I kept and another more recent one.
I feel heartbroken as ive spent the last 5 years getting everything sorted and never missing a payment etc and saving like mad to try get a mortgage in 2013/2014 – even more so now im expecting my first baby in feb - and now I feel like this has pushed me back another 2-3 years L
Ive contacted experian and they keep saying they cant change the data unless its changed by capquest but I don’t want to contact them as this debt is about to cross the 6 year period where ive suffered for not paying it but it will fall of my report and this nightmare will be over – I don’t know if contacting them will mean I recognise the debt which ive previously argued against as it wasn’t me! Also I don’t want to make contact as they have hounded me for a significant amount of time and that’s just stopped pretty recently and ill be honest I find it terrifying!

Please help if anyone has any advice! L

    Crapquest should not have altered the default date. That is grounds to complain and get it corrected, and if they refuse complain to the ICO and via the FOS.

    While you may feel the debt is not yours, if you signed up to an account and allowed someone else to run up a bill, then I'm afraid it is. :(

    So you have to decide which is more urgent?

    - Complaining and getting the default date corrected, even though this may involve acknowledging the debt before the 6 year limitation period is up?

    or

    - Sit and wait until you are sure the 6 years are up and then complain?

    Hello - I have had success before speaking to lenders where they have recorded the wrong default date - not quite your circumstances, but I would suggest contacting them and asking on what basis the default date has changed - if it was a default at all, it would have been way back when the original agreement was broken - if they have recorded it again as a default when they took over the debt, they would be wrong - there can only be one default IMHO, that was when the original agreement was renaged on by your ex. Best of luck, but I would def phone them and challenge them.
  • Thank you guys. I think i will stick it out until the 6 years from the original default date is up and then challenge the change in date. Im not planning on getting any credit until i try for a mortgage once I have a deposit anyway which I think will take me past the 6 year mark. I over the past years have come to accept that if I signed up, regardless who for, it belongs to me - just a shame i learnt the hard way - but still a lesson learned and defo a mistake I wont be making again! :) Thanks for your replies - at least im pretty sure now that they have got it wrong - its just a waiting game until I can get it sorted xx
