Advice re bankruptcy (Scotland)

Hi all

I have just been made bankrupt in the past couple of weeks.

At the moment i am currently on Job Seekers Allowance and understand that if i do manage to find a job within my 1 year bankruptcy period then i will need to make contributions from my earnings for 3 years.

The dilemma i have is if i do manage to get a decent salary then virtually all of it will have to go to the OR and i am not going to get the benefit of my wages

Or even if i do go for a miminum wage job then it it unlikely that the OR will ask for me to make a contribution as i would have only roughly £30-£40 disposable income after i have paid all my expenses. (I would actually be better off staying on JSA)

Has anyone else been in this sort of situation?

Part of me says that the best thing would be to try and remain on JSA until i have been discharged from bankruptcy and then start afresh without the worry of having to make 3 years worth of contributions from my earnings.

Just to let you know i have worked for 11 years and this is the 1st time i have ever had to claim benefits.

If anyone has any advice that would be appreciated

  • It really is upto you, but i dont think i would be putting my life on hold for the sake of a IPA.

    After Rent, Council tax, bills, food, and every other items of living expenditure i doubt there would be much left for an IPA? guess it depends how much you will be earning
  • I have compiled a SOA and my monthly expenditure would work out at roughly £1050 (whilst in employment). If i do get a job with a net monthly pay of say £1100 then i would need to pay the £50 surplus for 3 years.

    I just feel it would be best to tryand survive on JSA for the year then can start afresh after being discharged.

    Just wanted to get other peoples views on this and if they have been in a similar position

    I have checked the CCCS guidelines as per above and they say th max figure for food/toilt/clean is £202. I can maybe adjust my figure to £175.

    With re to gas/lec i currently use pre pay meters for these. I can maybe adjust to £70.

    One thing i was wondering is would the OR expect me to cancel my Sky Subscription or would this be acceptable?
