See my post #14 with the section from Wonga's website.0 -
So technically I could take out a PDL and then pay it off on my wifes card (with her permission as we are married). Two years later we've split up and gone through a divorce and I can ruin her by taking out PDLs and letting them take the money from her account...
In this case, could they also argue that the brother committed fraud by taking out a loan with incorrect payment details.0 -
putting something in your t&c does not make it fair, or legal, or acceptable.
the oft have clearly stated that this practice is unfair regardless of a companies terms and conditions.
if wonga had in their t&c that on non payment they could sell the organs of you first born child to pay the loan would that be accpetable? fair? legal? no
quoting the t&cs is irrelevant.
plus of course the op is not bound by any such contract t&c as it is not their loan.0 -

Technically yes, hopefully CPA's will become more transparent as they do not work anything like DD's or SO's0 -
In many ways despite what we are all saying someone put it well...Wonga have their money and the OP will get their money back too.
Difference is the PDL co have just made sure its not them who are waiting for it. Personally I'd send a complaint in as I suggested and if that gets nowhere drop it and go slap your brother around his head.
Infact, go bailiff style on his !!!!Debtfree!0 -
I dont think anyone is arguing it's fair or acceptable (to the OP).
However it is legal until contested in a court of law.0 -

no. because making a one off payment on a card from a 3rd party does not give consent to take that further as a CPA0 -

If that's the case then this is where the OP needs to be investigating.nottoolate wrote: »putting something in your t&c does not make it fair, or legal, or acceptable.

No more money can be taken from my account as there wasn't a continua s payment on the transaction apparently.
Just a debit card payment to wonga .com one off.
They said they can see no tag just the payment should i be asking the bank for anything specific on the transaction. they tried my card details once and once only.
I think this has been a good debate today so far.0 -
If there wasnt a CPA then it can be argued that the payment was not in line with the PRS 2009 I mentioned above.
Did you ask the bank how they took payment for a third party without the use of a CPA?0
