DCA Order to obtain information

Hello lovely people,

I am after some serious advice. I have just returned from a 2 year working holiday only to find out that whilst I was away there had been a CCJ registered against my name and the DCA are now threatening to go to court again to obtain an order to obtain information.

The debt in question is with Santander and is being enforced by DrydensFairfax Solicitors. It's not a lot, £800. Unfortunately it's £800 that I do not have lying about under the mattress.

I probably should mention that I did not just pack up and leave back in 2010, leaving all my debts unpaid. I had made sure that everything had been paid. Unfortunately this Santander account had been entrusted in my then husbands hands to be settled- and he assured me that he did.

Anyway, I am now in need of some advice as to what to do. The letter said that I could go to prison if I do not respond/ take action. I most certainly do not want to do that. Do you think that I could send them a cheque for £50 (the court order was £100 a month) and say that I will be making a final payment in January once I get paid? I am staring my new job in 2 weeks time and will have my first salary in January, so will be in the position to repay the debt.

Any advice would be welcomed.

    Have you any ideas as to what this debt might be in relation to? Possibly an overdraft?

    I can guarantee Drydens will have found out that you were out of the country and wilfully filed a claim against you knowing full well that you were unable to defend.

    Is the letter that you have, from the DCA, or is this an official court document?

    The next course of action, entirely depends on how you wish to progress. If you wish to just pay this over time, then contact the company, explain the circumstances and make a reasonable payment offer.

    If you wish to dispute this, and apply to remove the CCJ from your file, you can make application to the court to set-aside the judgment. As you were out of the country at the time, and had no awareness of any amounts owed, this should be pretty straight forward (dependant on the judge).

    Copy up the letter, removing all personal informaiton / account references / amounts etc so we can have a better look?
