    Robson Way should supply you with a true statement of account showing the payment, the date, the reference, the amount and any other information necessary to chase it.

    Just as a side bar...you didnt pay it did you? You ARE sure they're making it up? They have been known to give random payment details, but they really ought to have something concrete other than a 5 line letter, as you say.

    Keep refusing to engage with them, only correspondance via snail mail counts now.

    I m sure i ve not made this payment as i moved house in 2005 and made no further payments

    also if Robway are so sure i ve made this payment why bother to add in the statement about default ?

    For the same reason that I can threaten to report my neighbour to the police for opening my mail. Most people have no idea of their rights and will do what they are told if the figure giving the order is perceived to have sufficient authority. Its called 'social compliance' in sociology. Conmen use it too...I once watched a man hand over his car keys to a pair of (smartly) dressed conmen to claimed to be the police and waived what appeared to be a warrant card in his general direction. He promptly complied, because he had been socially conditioned by numerous american cop shows to believe this was 'legitimate'. The truth is, no British police officer has the right to commandear your private vehicle and even in America is only allowed under very specific circumstances and only certain States.

    They use big words, they pretend to have authority but the truth is anything but. They will for instance claim that a doorstep collector will have the 'right' to enter your house and recover goods...they dont. They have as much right on your property as I do.

    Nothing short of a court appointed bailiff backed up by police with a warrant of entry can walk into your house and no court in the land will EVER grant THAT for a civil debt. No way, no how.

    Your best defence is to know your rights.

    I can now update you regarding my ongoing dispute with Robinson Way

    to recap
    Robinson Way had made contract with me in spring 2012 regarding a debt that was older than 6 years .
    Following advice as shown in this trail
    I had various responses back from RobWay assuring me that the debt was not statute barred ,and they provided fake dates for payments ,and default dates ,all untrue
    I responded using the "Prove it" templates and threatened reporting to ombudsman etc
    today I recieved this letter

    "we refer to the above account (for £1,159.44) and aknowledge your recent communication
    Having reviewed your comments ,we can now advise that we have closed your account in our files and you will recieve no further communication from ourselves in this matter .
    If you have require any further information please do not hesitate to contact us "

    I will be writing back to acknowledge this letter and to remind them that if they pass on my details to another collector I will make complaint to Ombudsman/OFT as orginally threatened .

    I am back to update you on my dear old friends Robinsonway


    To recap


    Robinsonway had made contact with me in spring 2012 regarding a debt that was older than 6 years .

    Finally they wrote to me on 24th of January 2013 stating the following

    "we refer to the above account (for £1,159.44) and acknowledge your recent communication
    Having reviewed your comments ,we can now advise that we have closed your account in our files and you will recieve no further communication from ourselves in this matter .
    If you have require any further information please do not hesitate to contact us "


    I've had no further communication with them until I received a letter yesterday (10 December 2014 ).
    The letter states that I owe Hoist Portfolio Holdings 2 Limited £1,159.44 and I am to contact ROBINSONWAY to arrange payment .....If I believe I don't owe this money I am to contact Robinson way with "all the relevant information".


    At the bottom of this letter it states Hoist Portfolio will store my personal data for the purpose of collecting the above balance .




    • I have written that I do not acknowledge this debt and enclosed a copy of the letter from RobWay stating the account was closed.
    • I have also advised that I will be making a complaint to the Financial Ombudsman on the grounds that my personal data should have been removed from their data bases on 24 January 2013 , and there is no viable reason for retention by RobWay and their associates .
    • I have asked for a Final Response from them on this matter .


    Has anyone else had similar experiences with this company?

    It sounds like Robinson Way bought the debt from Capital One and used Horwich Farrelly to chase it. Eventually they had to accept that they had bought a dud one (statute barred), so they sold it on, to Hoist, who then decided to appoint a debt collector who was ... Robinson Way!

    It will be interesting to see what the FOS make of this.
