gross misconduct

Just don't know what to do.

Last week I was suspended from work on full pay while they carried out an investigation into gross misconduct.

I had to go for a meeting with hr to establish the facts. I did cooperate fully in their investigation. The reason I was suspended is without going into too much detail, I had my partner helping me in my shop. The company claim they knew nothing about it but up until a few months ago my partner was receiving calls and texts asking him to work in other branches so I did not feel having him with me was a big issue. I did state this in the meeting that this was happening but they would not listen and did not believe me. During the whole interview I felt bullied into telling them what they wanted to hear as there was just I and HR and area manager.

During this interview I was told that the best thing I could is not turn up to the disciplinary hearing so I didn't.

I received a voice mail message later in the week asking me to collect my disciplinary letter from my place of work in this message HR say "I know you at not planning on coming along".

Today is when I was going to have my disciplinary hearing but I did not attend 2 hours later I had another voicemail saying I was dismissed for gross misconduct.

My question is will this affect any benefits I could receive I am quite worried about what happens next. This job was my only income for myself and 2 children and as I was suspended I have not had any money for essential living for a week.

  • For a start this is wrong 'as I was suspended I have not had any money for essential living for a week.'. You have to be paid during the suspension - you still work for them during that period.

    You should have gone to the disciplinary meeting as well - who was it who advised you not to attend? If you haven't complied with the disciplinary process then it's hard to take it to a tribunal, should that be an option, but on the other hand, if they told you not to attend then that is something the tribunal would be interested in as it's the employer not complying.

    I don't know much about benefits but being dismissed will, I believe, effect any claim for JSA. With children though, you should be entitled to other benefits.

    If you want to learn a lesson from this then either a)your OH was not employed by the company so shouldn't have been working with you even if he works for them elsewhere sometimes without their permission or b) if you employed and paid him for his time then presumably it would need to go through the firm's formal employment unless you have the authority to take on staff, but even then due to your personal relationship it's likely there is a requirement to involve someone else.

    During suspension you should have been paid and it seems strange that someone would advise you not to go to the hearing to put your side but nothing can change about that now.

    Apply for JSA right away, they will investigate why the job ended and a sanction will most likely be applied.

  • A how long have you worked there?
    B does your OH work for them too? In what capacity?
    C who told you not to attend and have you got that in writing?
    D what is the exact reason you were dismissed?
    If you haven't got it - please don't flaunt it. TIA.
