Hamptons Legal. And Default.

I got my credit report and there is an account open by LOWELL FINANCIAL reporting defaults each month on my report?

This is for a card that I defaulted on nearly 6 years ago.

The default date is 14th Sep 2001.

What do I do? Ask for the credit agreement and not admit to the debt? Avoid it till September ?..

But this other arm Hamptons Legal are now sending letters threatening court action and CCJ's Ballifs ...this kind of nasty stuff?

WHat do i do?

    Are you being chased for this debt or is it another debt?

    If its not this one, you could try keeping your head down about it.

    If it is this one and it is your debt, then you should pay it.

    It is my debt...but it was 300 £ not 768 £ what they are asking for????

    thats over double. The card had a 300 limit on it.

    The company can report defaults each month. The 768 will be the original debt plus interest and charges. About 18% compounded interest rate on 300 (treating charges as interest), which isn't surprising for a credit card debt. The problem here is that in another topic you wrote that the credit card account was closed with a zero balance, so your actions there to find out what the debt is that they are chasing seem sensible.

    Can anyone help. My partner has been getting bothered by a debt company initially Red Debt Collectors, then Lowell Portfolio and now Hamptons Legal(who appear to be a part of Lowell Portfolio). They claim he owes a debt for a phone bill with one of the major providers but he has no idea from when this could be. Other websites have indicated that these companies are not to be trusted and under no circumstances to call them and we dont know what to do.
    Does anyone have any information on these companies and advise on what to do

    If he has never used that phone company he should contact the debt collectors and say so, asking them to send proof of why they believe he owes money to a company he's never used.

    If he used the company but it was more than six years ago since he last did business with them he should ignore this communication or tell them that while he believes he has no debt with the company, even if he had it would be statute-limited and uncollectable.

    If it's phone calls he can tell them that they must communicate in writing only. If it's letters then continuing to ignore them is also an option, until they actually start legal action and he's contacted by a court. Threats of legal action are ignorable until actual legal action has really been started, whcih is extremely unlikely to happen.

She has had letters from Red now she has a letter from Hampton/Lowell stating she has 10 days to sort out a payment/direct debit. the debt is supposedly a £300 from orange we have asked orange to verify they say that they do not hold those records when it is handed over to a debt collector. What do we do? She is a student in London, the letter is addressed to our house in Bristol with the word bailiffs in the letter and ccj quite worried as she doesnt have the money. Please help

    You need to send the prove it letter, disputing the debt, not signed and not admitting any debt.

    They should have statements etc that they can send you.

    Is it her debt?
