Barclaycard

So out if all my creditors Barclaycard are bloody useless. It's been a month to date I went bankrupt. Originally my debt with Barclaycard was with Mercers debt agency (part of Barclaycard) my debt is now passed to Calder debt collector (part of Barclaycard)

I get a call today at 8:59pm with them saying they can trace my bankruptcy details on line. I kindly say well you need to speak to the OR but they say no we need to speak to me until otherwise. I said and gave them my bankruptcy details again and said not my issue speak to the OR as now bankrupt.

Question is are they still allowed to contact me and should I speak to the OR and advise I'm being chased by a creditor?

    No, I don't think all other drivers are idiots......but some are determined to change my mind.......

    But may I add, payday lenders, especially erm, who was it, I forget, a few of about 15 payday loan companies (not wonga or quickquid though, who I insist are bloody angels compared to some of the scum out there) - kept chasing me despite EVERYTHING. I would have the O.R. contact them, I would send them copies of my bankruptcy order etc... and they just kept either 'losing' these things and continuing collections etc, or in some cases, after them acknowledging my bankruptcy to the official receivers, they still passed my account to a debt collector. NDR, absolute idiots.. one guy actually started shouting at me down the phone.. telling me he had investigators that knew I was lying about where I was living (I wasn't, in fact, if he would have gone on the insolvency register, my new address was on there!)... This did stop after a while, and I learnt the worst thing I did was engage and provoke it.

    Forward any letters or e-mails you get to the official receiver. They will come down heavily on the company, and that is their job, ensuring these companies do not harass you. If you can be bothered, perhaps forward them a copy of your bankruptcy order (the thing with the court, case number, a court stamp maybe etc, one single page) and it might shut them up, but you are under no obligation to do that... the O.R. can deal with all that now.

    I kept getting calls for some time, and depending how speedy your O.R. has been (mine seemed perhaps a little slow!), you might still get the odd calls or letters as things slip through the net, or if creditors fail to properly stop collections operations when they put a note against your account regarding the bankruptcy.

    A month in, expect a bit of that, but it should be dying down and as these two people said very clearly, dump this problem on your O.R. - it is what you have paid the fees for, and its a major factor of bankruptcy, you don't need to deal with these people anymore :)

    And rest assured, there are no procedures they can take against you except trying to scare you. I had debt collectors that KNEW i was bankrupt still try to get me to settle a several hundred quid debt for a few hundred, even though had I done so, I'd have been breaking the law due to non-payment rule... They can't take you to court, CCJs would not go through, because they cannot take you to court, no bayliff action can take place, and if they (they wont but, if..) sent somebody to your house, you could take some joy in telling them to go f**k themselves, and if you felt up to it, film it and send me a youtube link.

    My general point is, they shouldn't be doing what they're doing, you have nothing to be neither worried about, nor feel responsible for sorting out. Not your problem, just pass it straight on to the O.R., or rip up the letter and recycle it :)
