LILA Bankruptcy and HMRC tax credits overpayment!

I completed the paper work to for LILA Bankruptcy yesterday, with a CAB advisor my debts total £13,000 and My partners £5,000 He is doing the DAS scheme. One of the debts in my name is a tax credits overpayment from 06 and 07 totalling £4,500 but I was advised that this may not be written off at all still leaving me with £4,500 debt which I cant pay as there is only enough surplus income at the end of the month (£116) to pay my partners DAS. I have read that they may take payment from current entitlement (£79 four weekly) until cleared or until bankruptcy discharged. Anyone had tax credits overpayments written off? or able to advise what might actually happen?? I am concerned also that if they do take away the £79 we are currently awarded it will reduce the surplus to £37 per month I don't how this will affect my other half DAS or if its even enough to stay on that? really confused!

  • Thanks, I am finding it really hard to find much information regarding Scottish Bankruptcy, but in particular regarding money owed to HMRC and what happens.

    Until a Scottish post can advise further I would ring AIB for further info.
