Aktiv Kapital have ignored payment plan?

hi all

First time poster, long time reader. Most of the threads I've read go on about avoiding paying Aktiv Kapital so can't see a similar thread to ours but here's our story (sorry, it's long...)

About 6 years ago we took out a joint credit card through MBNA which, due to circumstances at the time, we ended up being in debt to. It ended up we couldn't afford it and then we moved (again, through circumstance).

Payments ceased as we had no money at the time and we acknowledge that, but we did try restarting paying the debt about 2-3 years ago (the debt is about 7K, got down from 12K). Then it disappeared off the statement and MBNA said the balance was 0 as they'd sold it on and could give no further information.

Now we have been located by AK who have stated what we owe but they would give us a payment plan and we went online to do that, to pay 150.00 per month and they would pay the balance (so we end up paying only about 4K). Want to do this as it would sort things out and we don't want to be in debt - it was just past circumstances which led to the problem. We're not avoiders! We just don't have sufficient money...

We have paid one payment so far (the next one is due out in a couple of days) but the thing is - they keep writing to us!!! We had a letter in October chasing it which we ignored as we thought it may have crossed with our Blue Payment Plan, but now we have had another one saying we've not contacted them and will now chase more and send agents blah blah...

We've emailed the contact email available through Googling (the contact page on the website didn't work!) but this message came back:

info@aktivkapital.co.uk
The e-mail address you entered couldn't be found. Please check the recipient's e-mail address and try to resend the message. If the problem continues, please contact your helpdesk.

Even postmaster@ doesn't even work.

Really worried as they don't seem to have a joined up approach - surely if we have a payment plan in place for the particular reference number it should register on their systems?

Happy to keep paying the 150.00 per month to clear our debt but DO NOT want the letters chasing us (and potential other issues of chasing). We thought once the payment plan was in place we would be OK? How do we stop this chasing? It feels insulting to be chased for something we are trying to sort. Refuse to call any helpline as voice calls don't work. Need to have things in writing or more preferably via email as we're away a lot so post isn't always attended to promptly (not jollies, just family circumstance).

How can we get them to acknowledge the fact that we're happy to do a Payment Plan to sort it all out or - should we just stop paying as it's a scam?

Thank you.

Bill and Ena

It's typical of debt collectors to be honest. Their systems are invariably useless at keeping track.

I would write/email confirming your Plan, and state that if they continue to write/call stating that you are not paying etc then you will be complaining to the OFT and taking the matter to the FOS. Ask for a copy of their complaints procedure.
