    If it's something that you last had anything to do with 12 or so years ago, then it would almost certainly be statute barred.

    Plus recording a recent default for such an old debt would be grossly inaccurate and a very clear breach of the requirement of the Data protection Act, which requires default/CRAs records to be accurate and up to date. As such, you would have a very strong case for getting it removed.

    Tell Santander That this is a formal complaint that you will be taking to the Financial Ombudsman if they do not resolve the matter to your satisfaction, and it is their responsibility to deal with the complaint and that you will not tolerate any attempt by them to deal with it by RW or any other 3rd party.

    You may also want to tell RW what you are doing if they continue to hassle.

    Thanks Fermi, I will get my thinking head on and draft a letter to Santander. As for the 12 year thing I have absolutely no idea when I last had any communication about this account, it really was a long time ago.

    If you want a 2nd opinion, then give NDL who wrote that a call. They are normally very good on these issues.
