Direct Debit claim

This is a bit long.... time wise and description wise...
Sorry.....

Back in FEB 2008 I applied for a 3-in-1 package from Virgin Media. (Home phone, mobile and internet.)
In order to do this I had to complete a DD.

After completing I got an email the same day saying they couldn't supply me with a mobile.
I called them back and told them to cancel..... got passed around until eventually I got someone to promise to cancel on the Monday morning.....

On Monday I was off to France for work.....at the time I lived jointly between the 2. My UK account was just mainly used for Rent and Utilities..... but I was travelling for work very extensively (4/5 days I was rarely in either of my flats)

When I got back I got a card through the post saying they had tried to get access to install my internet.... I went through the whole loop.... and got old again it would be cancelled.

This continued with me thinking the matter was resolved.
My statements went to the 'other address' and I was so bogged down with work/travel that they continued to bill me.

On Aug 15 I wrote to them to complaints. I asked the money be reimbursed. I copied my cousin (solicitor).... and asked them to reply IN WRITING.

I got a reply from their 'Customer Complaints Manager' stating they had tried to contact me by phone.

This seemed strange and an out and out lie as they had no number to contact me!

I never received any refund, in total they took £168.08 from my account.

I recently had to close the account this was paid into for reasons of idenity theft.

How do I go about this?
Do I try Virgin again?
Do I go to the bank (who I have another account with)?
Do I just send them an invoice? and if they don't pay go to small claims?
