RULES
1. The following rules (“Rules”) together with Global Radio’s ("Global Radio") general and competition terms and conditions (the “Terms and Conditions”) (which can be found at (http://www.capitalfm.com/terms-conditions) apply to Capital’s Secret Santa with BlackBerry competition ("the Competition") which will run from 12th November to 5th December 2012 at 23.59 (“the Duration”). The "Radio Station" is the Capital Network. The promoter is Global Radio Services Ltd, 30 Leicester Square, London, WC2H 7LA.
2. Anyone who participates in Capital’s Secret Santa with BlackBerry Competition (a “Participant”) will be deemed to have understood these Rules along with the Terms and Conditions and will be bound by them. The Terms and Conditions are available on request from the Radio Station.
3. Entering
3.1. To play Capital’s Secret Santa with BlackBerry a Participant must either visit https://www.capitalfm.com or log into Facebook and visit https://www.facebook.com/capitalfm and click on ‘The Secret Santa’ tab beneath the cover photo. Online entry will open on 12th November 2012 and close on 5th December 2012 at 23.59.
3.2. Participants must allow access via the Facebook authorization pop up box and read and agree to the Terms and Conditions to be able to play. If Participants do not allow access or don’t tick the box to agree to the Terms and Conditions then they will not be able to proceed.
4. Being ‘Secret Santa’
4.1. Facebook users (Participants) who allow the application access to their profile then have the opportunity to select nine (9) friends to whom they would like Capital to give a gift. These Participants will be referred to as a ‘Secret Santa’. The gift that each of the 9 chosen friends will receive will range from a selection of gifts grouped into 3 tiers: top, middle and lower tier. A ‘Secret Santa’ must select a minimum of five (5) people and a maximum of nine (9) people; they will not be able to proceed until the minimums of five (5) Recipients have been chosen.
4.2. A Secret Santa has the opportunity to gift themselves and additionally select up to a maximum of nine (9) further friends if they find and input a secret Christmas Bonus code which has been generated by Capital FM. There will be a field, which will allow a Secret Santa to enter the Christmas Bonus code, to redeem their gift and select another 9 Recipients. A Secret Santa can only gift a Facebook friend once and cannot send additional gifts to the same Facebook friend after redeeming a Christmas Bonus code. An entrant can only use each Christmas Bonus code once but can enter up to 4 codes per twenty four (24) hour period. There will be 24 secret codes in total, which will be distributed through the following platforms:
• 5 codes will be distributed by Capital: 1x On-air, 1x Capital’s Facebook Fan page, 1x @CapitalOfficial Twitter, 1x Street Stars promotional team, 1x Capital e-newsletter.
• 4 codes will be distributed by BlackBerry via their UK Facebook Fan page (https://www.facebook.com/BlackBerryUK and or @BlackBerry_UK Twitter feed).
• 6 codes will be distributed by Capital’s Partner websites.
• 9 codes will be distributed by the official social media feeds of artists performing at the Jingle Bell Ball and or by their unofficial fan feeds including some of (but not limited to) Facebook fan pages, Twitter accounts and blogs.
4.3. Once the code has been accepted entrants will be shown a congratulations message stating which prize they have won.
4.4. Christmas Bonus codes will be open for entry from 12th November until closing on 5th December 2012.

5. ‘Secret Santa’ Recipients
5.1 Facebook users who have been selected to receive a gift from their friends (Recipients) will be alerted by a notification for an application request on their Facebook page in the ‘notification’ jewel. By clicking this Recipients will see that they have been given a gift.
5.2 Before clicking ‘unwrap your gift’, Recipients must read and agree to the terms and conditions. They have to allow access to the application via the Facebook authorization screen to proceed. Once accepted the Recipient will be able to view the gift they have been given, and will have the option to claim it. They in turn will have the opportunity to become a Secret Santa and nominate 9 friends to be Recipients.
5.3 Recipients will have 48 hours to open the notification and claim their gift. If the Recipient fails to claim their gift within the 48 hours it will return back to the pool and be redistributed.
5.4. The promotion will end at 23.59 on 5th December 2012. After this time, competition entrants will no longer be able to select friends to receive gifts. However, Recipients who have been sent gifts before this time will still have 48 hours to claim their gift, even if this period ends after midnight on 5th December 2012.
5.5. If they have been given a top or medium tier gift Recipients will be asked to complete and submit a form, giving their address and / or other relevant information. The form will contain the email address connected to their Facebook account.
5.6. Please note: It’s really important that Recipients provide accurate information. The Radio Station is not responsible for any failure to receive a gift due to inaccurate information being provided. For security purposes, gifts will only be sent to the address/email address provided during the claim process. Information gathered from this form will be used for the purposes of prize fulfillment only and will not be retained by Global Radio for marketing use.
6. Eligibility
6.1. If a Recipient is not based in the United Kingdom they will not be able to claim their gift.
6.2. If a Secret Santa is not based in the United Kingdom they will not be able to claim their gift, those Recipients based in the UK are eligible, subject to these Terms and Conditions.
6. 3. Members of staff, casual staff, contractors and freelancers for Global Radio, BlackBerry and Holler may take part in the promotion as Secret Santa, but may not redeem any top or medium tier gifts allocated to them as Recipients. They are eligible to receive lower tier gifts.
6.4. There is a minimum age limit of 13 years or over to participate as either a Secret Santa or a Recipient. If a Recipient is aged 14 years or under, and their gift includes tickets to Capital’s Jingle Bell Ball, they will be required to have an adult 18 or over present to attend.
7. Multiple Entries
7.1. There is no limit on how many times a user may be selected as a Recipient or on the number of prizes they may redeem from any prize tier.
8. Allocation
8.1. At least once every 24 hours we will give away one top tier gift.
8.2. Top tier and medium tier gifts will be spread out as equally as possible throughout the game using a metric based on the number of Recipients selected in a given period.
8.3 Prizes are allocated at random.

Will be sent to the Recipient at the address provided during the claim process by Special Delivery within 30 days of the Recipient claiming their gift.

9.7 Tickets to Capital’s Jingle Bell Ball with BlackBerry claimed before 23.59 Sunday 25th November will be sent to the address provided by the Recipient by Recorded Delivery. Tickets to Capital’s Jingle Bell Ball with BlackBerry claimed after midnight Sunday 25th November will be held at the box office at the O2 arena, and must be collected by the Recipient claiming the gift. For security reasons, the Recipient must claim these tickets in person, and they must show photographic ID (driving license or passport) on collection. Failure to do so may result in disappointment.

9.8. Other middle tier gifts: will be sent by Royal Mail post to the address provided during the claim process within 30 days of the gift being claimed.

9.9. Lower tier gifts and digital gifts will be provided for instant download once the claim process has been completed.

10. Technical Issues
10.1 In the unlikely event that gameplay is suspended due to unforeseen technical issues resulting in gifts that cannot be redeemed by Recipients within the allotted forty eight (48) hour period, Capital FM will ensure the expiry period for these effected and unredeemed gifts is extended by an equal period of time to that of the technical down time.
