  • So basically there is no way I can find out other than a credit reference agency?

If you had been made bankrupt in your absence, then your details would appear here:

    http://www.insolvencydirect.bis.gov.uk/eiir/

Reason being that the Official Receiver would not be able to do the admin for your bankruptcy without speaking to you and you cooperating with them. If they can't do that then your discharge from bankruptcy would be suspended, meaning you would stay on that register listed as bankrupt indefinitely.

If you are not on there then it's 90 something % certain you were never made BR.

More certain that a credit check anyway, as those frequently get things wrong.

I have checked the bankruptcy website and my name does not appear on it.

    Good

I don't want to do a credit check as I have to put my address details in and I don't want to do that as I don't know where I stand, I really could not do with the stress of what may come of it.

Giving your current address won’t link you to the old address unless you give them that too or they already have the link on your file.

But equally, CRAs match even bankruptcy records against your file by name and address, so if you were made bankrupt in your absence at the previous address you would need to give that to the CRA for any bankruptcy to show.

    Catch 22.

If you want to do a CRA check to see if there are any BRs you are unaware of, you need to give a full address history that covers the period.

  • So how do I start the process of moving forward? I couldn't even tell you who and how much I owe.

Have you checked for your name on the London Gazette website?

Can I just ask whether you think part of the past debts will be a mortgage shortfall?

On other debts after 6 years (assuming no court action was taken), then most debts would be statute barred and unenforceable against you.

    Mortgage shortfalls take 12 years.

It was a mixture of mortgage, loans, credit card and car loan.

If court action was taken where do I stand?
  • I'd still look and see if you have a new credit file - you do have a current bank account don't you?
