Boss doesn't have enough money to pay wages'

Hi There

I work for a small Limited company, just recently we have had a new director take over and he has a terrible attitude towards staff and customers.

Yesterday he threatened me that he wont have enough money to pay wages this month. We are minimum wage workers. He is also making lots of unattainable targets and said I am not doing my job when I know I am doing it to the best of my ability. I have worked for this company for two years.

Any advice on what my next steps should be.

Thanks Bella

You need to establish with him exactly what he thinks you are not doing that you should be. There may be some miscommunication which you need to resolve before he starts any formal proceedings regarding your performance.

As for the money side, it sounds to me like he frustrated and that the company is not doing well financially, so said that because he wants to make you understand just how bad the situation is. If he was actually unable to pay, then I believe the company would liquidate and you would claim unpaid wages from the administrators. If he just refused to pay then you go to small claims court.

Sorry to say it but getting another job would seem to be a sensible move.
  • Just you or everyone who works there?

When you do not get paid put in a grievance for an illegal deduction andthen seek legal advice
  • There are only three of us that work there including the boss. What we have is to do is go through lists of people to make appointments, to remind them that they are due for a check up. However, we have tried to stress to him loads of time that virtually everyone has been phoned and we are struggling with the lists we have.

He is making the same allegations/threats to both employees.

I am looking for another a job but there is not much about.

If he only employs 2 people, and feels that he can't afford to pay you both, then he should give one of you redundancy.

Perhaps if you are struggling to contact people by telephone, presumably because they are at work, you could suggest introducing email contact, or a later evening once a week to try and catch people when they have finished for the day.

Email would then mean you also have solid evidence that you have been trying to contact people.

I also note that 'virtually' everyone has been phoned? Once? twice? I'm going to take a leap and assume you work for a dentist who is sitting around without any patients to treat. If I was him and my receptionists were not constantly on the telephone, because there were no patients to deal with in reception, I might be a tad annoyed too, to be honest.

  • Liney it is an opticians. We spend all day between 9-5 calling between customers so it is constant. Most people have now been called four or five times.

If I were you I would speak to him about alternative ways to contact customers. If you are proactive about making some headway he will know you are at least trying to do as you are asked... and put you in a better light if a redundancy is on the cards.
