down.butnotout, it's rare to get such criticism and judgement on this forum as you'll see from having a read around so don't let this put you off. You've done the right thing getting expert advice from CCCS and they can help you decide knowing your full circumstances which people here can't.
My fil lived with us for years while he was unwell, it wasn't charity, it was what I chose to do - he was family and I loved him.

Thank you PippaGirl for your words, with the mortgage at £789 and secured loan at £394 my benifit of around £700-800 isn't going to cover anything plus living expences. I can only see BR as the way out as CCCS have advised. Its just !!!!! and hard enough to keep the chin up.0 -

Now Eellogofusciouhipoppokunu didn't like my comment; they think that repo is never in the debtor's interests. Which is a fair enough as an ideological viewpoint, although anyone with any experience of actual debt cases will tell you that the contrary is often the chase. Challenged to cite an example, I pointed them in the direction of this thread. As you can see from the above, after much questioning of down.butnotout, Eellogo has eventually come to the realisation they have actually put some though into their predicament, taken advice from CCCS, and that repo and bankruptcy is the least worst option.
Rather than face up to the awful reality that they might be wrong, Eellogo has come to a different conclusion, you down.butnotout are not real, you are in fact me. Yes it is. Life sometimes has a tendency to throw !!!!! at you. But you can get through it and come out the other end. And you've done the right thing, recognised the problem, taken advice from CCCS. Life doesn't end with bankruptcy.0 -
Hi down.butnotout, as pippa said its unusual to get comments you got however well meaning they were ment, most will give you the facts you need but without the critisism. I contacted all the main debt charities but found speaking to someone face to face helped me, ( C A B ) They went through everything with me, supported me, gave me all the advice i needed and filled in the paperwork when they advised and i decided to go down the bankruptcy route. Although cccs and nat debtline were great i needed the face to face advice,
Dont think your alone there are great posters on here that will give you great advice of the ins and out of your situation and others that can only comment on their own situation but can offer great support ( like me ). Hang around for others to give you advice, take care

I'm due to speak to CCCS again next week. I really, really don't want to go bankrupt but can't see any other way out. Very niave question, but what happens if I don't delcare bankruptcy?0

Hi down.butnotout and Welcome to the Bankruptcy (BR) Board. First step is to make a list of all your creditors, debts and assets. Secondly and most important is contact one of the following debt charities. Please try these they don't charge and are impartial. They will go through all your options with you and if they suggest bankruptcy then come back to this board and we will help you all we can. Also if your not ‘clicking’ with one of the Debt charities do try another. We advise you to try at least two others for your own piece of mind. Your BR could be refused if you have not sought advice.

I handed back my keys back in 2007.
There was equity in my property but it would be taken as part of br anyway.
It was the right thing for me at that time.
Going forward nearly 6 years the issue with it is it cuts down even more the amount of mortgage lenders who will lend to me now.
I guess in your case its a small issue as it would have been for me back then.0 -

the property would be taken/repossessed and sold. Once sold you are no longer liable for council tax etc.
The mortgage would be paid off if possible, if not there will be a shortfall, fees for the repossession and sale would be added to this shortfall all of which you are then legally liable for. The lender is likely to take legal proceedings against you to try and recover the shortfall you owe for as long as is needed or is possible. If that shortfall is a managable amount some people would try and negotiate an affordable monthly figure to pay it off rather than go BR. If the amount of shortfall is not large and you have no other unsecured debts then that may well be possible."Our prime purpose in this life is to help others.
