  • Hi I am filing for bankruptcy in the next 2 weeks just waiting for pay day, I have been paying my ex partner £400 a month cash for child maintenance for the last 6 months, will they contact her for proof? Many thanks.

    Hi. Is an advance on my first universal credit payment seen as obtaining credit? I am in a DRO until next month and have asked for 501.75 so not much over the 500 limit but should I tell the dwp of my DRO before I get the payment through? Only 401.75 is coming tomorrow and the rest on Wednesday.

    For anyone interested, I spoke to stepchange and they confirmed that an advance is not considered a credit application, it's money to live on which you will be entitled to in due course

    Welcome to the forum and thanks for posting.

    The official receiver (OR) can look into any areas of your finances that they feel the need to, so it's not impossible that they'll ask for evidence of this payment.

    For more information on these sorts of queries, the best place to go is probably the Insolvency Service enquiry line, details of which can be found here: www.gov.uk/government/organisations/insolvency-service

    Thanks for posting.

    Property is usually addressed within the terms of the IVA proposal, so there shouldn't be any problem unless it was specified in the original proposal.

    I'd advise to either check the proposal and/or speak to the supervisor (insolvency practitioner) of the IVA to make sure, before you look to sell the property.

    I had a horrible man from the council phone me today stating that I owe 8k in over paid housing benefit! I don't! Wen I tried to explain this to him he became threatening and aggressive saying he's going to rush it through the high court and I cannot attend and because I've had bailiffs 4 times in the past hes going to use that against me and come in and take my stuff. I don't owe it nor have it! Am I better off declaring br to make them go away? I'm beside my self wiv worry

  • I am retired with no aditional income. My interst only mortgage has come to an end and even though I have asked the lenders to extend the mortgage until the house prices improve they have refused and given me a month to find an alternative. I am thinking of just going for a voluntary reposession and then going bankrupt so that I am not pursued for a shortfall which I would not be able to pay anyway because I only have my basic pension to live on. I am not worried about this affecting my credit rating because I do not intend to borrow money . Please can I get some advice on the best way to move forward on this as really I dont care about the place any more I just want to avoid being harrassed for money. I have always paid the mortgage on time but cant see the point if they just intend to through me out anyway.
