    Hi just wondered if going br was an option. In negative equity with the property, minus £300 each month due to change in tax credits and landlord issuing a forefiture notice. Have posted my soa on the board for help and seeing the cab but not til 8th may.

    Any help much appreciated

    Before you make any decision on going bankrupt it’s best to get expert advice. We have a specialist bankruptcy team able to support you through any decision.

    If you have your SOA you can use our confidential online debt advice tool – Debt Remedy (http://www.stepchange.org/msehelp)

    Debt Remedy is based on your financial statement with information of household, income, expenditure and debts. From this it will recommend the best debt solution to your problem.

    From there our bankruptcy team may be able to help.

    I've got an IVA with Debt Free Direct and my annual review is due in June.

    I just need to ask a question which I am concerned about.

    Its asking me for 3 months of bank statements.

    I play bingo online once a week as a treat because I dont have any luxuries.

    I usualy deposit either £20 or £30 a week.

    This cost amount to what it plays in the actual bingo hall itself.

    I also use ebay a lot as well, ie paypal, to buy christmas presents with.

    Would the IP say I am spending too much?

    It's up to Debt Free Direct really. I'd suggest being upfront with them, give the same explanation you've used in this post and seeing what they say.

    I don't know what their reaction is likely to be but generally speaking it's much better to tell your IVA Supervisor about this sort of thing rather than wait for them to contact you about it.

  • Don't really know if this is in the right bit because its first time I've used this site so bare with me please. I was made bankrupt in 3rd jan 2012 and was discharged 3rd jan 2013. On the 16th of January I started a claim against the local hospital for negligence. I have just heard I will receive £3500 next month (may 2013). Am I entitled to this money ? Do I need to declare it to the receiver ? I am desperate to buy a car and their is no way I would ever be able to save up this amount.

    Hello,

    The insolvency service website says: No assets you acquire after your discharge can be claimed by the trustee in bankruptcy.. Here's the link: http://www.bis.gov.uk/insolvency/personal-insolvency/discharge#assetsafterdischarge.

    So if you're acquiring this money after your discharge then I can't see a problem. If you've got any doubts about the technicalities then it may be worth giving your Official Receiver's office a call.

    Hi there

    I went BR end of last year and I am still undischarged. My partner is whisking me off away in a few weeks to marry me. It will be just the 2 of us and a small cheap wedding of which he is paying for. He asked me and didn't want to wait for my discharge. I am a bit worried that the OR may frown upon this, will they be ok that I got married? I am panicking a bit when this should be a happy occasion! Also, he won't be liable for anything regarding my debt will he?

    Hi New Chapter,

    Firstly congratulations! I hope you have a lovely day.

    The only reason I can think the Official Receiver would have any issues with your wedding would be if you were using your money to pay for it. They'd obviously prefer it went to them instead. If someone else is paying for the wedding then it should be fine.

    If you'd like the extra peace of mind then I'd suggest getting in touch with the OR's office and run it past them.

    Your future husband doesn't have any responsibility for the debts included in your bankruptcy (unless they were in joint names) so I can't see any problems on that score.
