Lieu days and sickness

My husband worked two Bank Holidays earlier in the year and booked two lieu days to be taken this week. However he is off sick and has submitted a doctor's note.
Will he be entitled to rebook the lieu days on his return to work?
He is expecting to be refused!!

I know its been changed that it has to be given back to you if its officially holiday now. I can't find anything about TOIL though - since TOIL isn't as regulated and is an 'extra' as such.

Ok then, if he produces a sick note he is entitled to claim them back and claim sick pay, if he is only entitled to basic ssp then he may be better taking them as holidays so he gets his full pay.;)
