I completed my sale within the timescale they set and yet they have not paid me the 5K as agreed. I have a letter where they offered it to me.
Shall I go to small claims court?

Was it charged when your sale completed?
They are agreeing to waive such charges, so I presume they don't charge it, rather than charging it and refunding it back.
