Wrong employer giving p60?

My partners tax was messed up by his old employer, they didnt take account his earnings from april 05 to Nov 05 when he started working for them so he wasnt taxed on the first whatever of his pay...got that sorted.
However, this March 07 he stopped working for them and started work for another employer.
A P60 from the old employer has turned up. Am I right or wrong in thinking his P60 should be from the New (March the 1st 2007)Employer?

You should get a P60 from each employer you have worked for during the tax year, so it's right that the previous employer has sent one, and your partner should get one from current employer too.

Oh right...:) Thank you! And for Tax Credits add up the amount on both?

you should not get a P60 from each employer that you work for in the year. The normal course is a P45 from an employer you have left and a P60 from the employer you work for at the turn of the tax year.

However, an employer is well within his rights to issue a P60 to an employee who has left their employment within 3 months of the end of the tax year.

Any ideas when we should expect one from New Employers? Is there a time scale/limit?

They have to be issued before end of May.

The HMRC's guidance is that a company should only provide P60s to those employees in employment with them as of 5th April in the tax year, so I would be surprised to find that they have received a P60 from an old employer.

The employees should receive them by 31st May.
