I got a temporary job but could be offered a fixed term contract

I am starting a new job on monday but I have not been given my notice period or a contract, it is with an agency so if I get the fixed term contract where do I stand? can I just leave?

    Ask the agency. Most temp jobs just require a day's notice

    Can I just ask the agency, what my notice period is? Does it looks very bad taste though to just ask.

    Of course. If you want to be a bit more tactful, you could remind them that you've still not received a copy of your contract as ask if they could email you a copy and then check it for the notice period required.

    Isn't that for direct employees? As an agency temp or contractor I don't think that applies. My contract (as an independent contractor) has just one day's notice for both me and my client.

    If you are placed at a job by an agency you are an employee of the agency, no? On their books?

    Not necessarily in all cases, some temps (contractors) get paid via an umbrella company or their own Ltd company.

    "The (Agency Worker) regulations will not affect the employment status of agency workers and there is no statutory minimum notice period for agency workers. Employers will still therefore be able to terminate agency workers' contracts on less notice than employment contracts."

    So from the OP's point of view, the notice they will have to give will be whatever is stipulated in their contract.

    Some (like me) are employees of the agency but probably the majority are not. Those who are not may be working through an umbrella company of some sort but others are technically working on a contract for services (as self-employed) not a contract of service (employed).

    I got an email on friday saying until the agency gets my bank detail and my p45 i will not be given a contract, i have emailed my last employer requesting a p45 but i could have this new job before the p45 arrives so i need to know what my notice period is.

    I will be sending the following to the agency:

    I understand that I will not be given a contract until you have received my payment details and a copy of my p45 but can I pleased have the following information: holiday requirement and my notice period?


    does that sound ok?
