Ok,we are very worried over things now.
Back in September we got two yellow cards saying pay up £x immediately to Allied Credit International for two old debts.They are still liable as it's under 6 years etc.One is a couple of hundered pounds on an old overdraft on a closed account,the other is a couple of thousand on a defaulted loan.
Anyway...since then they have been phoning regularly about the loan but not the OD.Each time I spoke to them I have requested a copy of the credit agreement or proof they owned the debt~they said they can't provide this and that we are stalling etc and pay up.We eventually spoke to a nice lady who said it was 99.9% unlikely they'd ever get the relevant paperwork regarding the loan and it's been left there.What can we do about that?
Then before 9am we got a voice text on our house phone from AIC asking us to call which we did.We got a rude abrupt guy saying we have to pay the £200 NOW over the phone or they would send bailiffs in.I asked for proof they own the debt and he said we were hiding behind the data protection act and were going to lose our house.I told him they were harrassing us but he kept saying YOU called us...we were returning a call.Do they voice text on purpose so you have to ring them?
Anyway he put the phone down on me and said see you in court....
We are now worried sick.We don't have the money to pay it and tbh they haven't remotely proved that we owe it to THEM.
Any advice would be very,very welcome please x

You are correct.
Have you asked them IN WRITING to put the credit agreement to you? I suggest you do that and get "signed for" delivery.
If they hafve no record of the credit agreement, they can see you in court if they want, but you have proof( with the signed for delivery) that you have asked for the credit agreement and if they dont have it they cant enforce it, and they will be laughed out of court.:beer: Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

He said there was no cred agreement regarding the OD as it wasn't a loan but surely they'd have the original agreement when the bank account was opened?
Also can we request they stop phoning now and correspond via letter only?I am sick of them ringing and being so bloody rude.:mad:New Year~New Start!!:beer:

These people try to frighten and intimidate you. You can write to them and state that any further correspondence MUST be in writing as you find the telephone calls harrassing and if they continue to telephone you, say firmly to the person who has phoned that you have requested that all correspondence is to be made in writing and that you would like them to clearly state their name and position within the company as all telephone calls will be recorded.
Be firm with them and don't back down. Good luck0 -

The Administration of Justice Act 1970 S.40 makes it a Criminal Offence for a creditor or a creditor's agent (often a debt collection agency) to make demands (for money), which are aimed at causing "alarm, distress or humiliation, because of their frequency or publicity or manner". Equally, a creditor will be committing an offence if they falsely imply that non-payment of the debt will lead to criminal proceedings; or the creditor pretends to be someone they are not e.g. a court official or bailiff.

You have done the right thing, you need now to write to them and say you will only deal in writing and no telephone conversations will be entered into.
