Cashback in shops.....

Hi, just a little something I noticed this afternoon....

I went to my local Co-Op this afternoon to use the atm to get some cash. It was broken so I went inside to buy a paper and get some cashback.
When I was given the cashback, I was asked to sign a piece of paper to say I had recieved it... This piece of paper was basicaly a list of cash back details, and customer's signatures! I was not happy to leave a copy of my sig wheere anyone could copy it from, so I asked them to cancel the transaction, which they did.
I work for a supermarket, and when we have a transaction that involves a customer signature, we have to dispose of the EFT slip thru our confidential waste so it is destroyed!

My question is, are shops legally allowed to keep a copy of customer signatures like that? Seems a bit dodgy to me!

Sounds about right, for the co-op. Anywhere else, no. You did the right thing I'd say..
  • Was it a Visa debit card by any chance?
You may have heard that the VISA system was down worldwide for some time yesterday and they have had to rely on the old signature system.

In a strictly legal sense I believe your signature is still your "mark". You don't have to write Sarah Needle1872 in nice copperplate writing. Put a meaningless squiggle or even an X - it means just the same ! Your signature is whatever you want it to be.

yes they can. we dont do cash back but we do keep our card details for 3 months in store. they are then sent to the h/o to be destroyed. No one sees them and no one uses them. It is actually for protection. Alot of people realise that if they steal cards they can copy sigs. they then go into stores like co-op and ask for cash back whilst buying something small like some gum. because cash back still requires a sig. instead of a pin, this is a popular option for fraudsters to use (as sigs are so easy - who honestly checks them THAT closely?!?) This helps to cover you as they can dig back for the receipt and will have to pay you back - so dont worry. x x x

This doesn't make sense ! If I ask for cash back in a supermarket, I still use my PIN, they ask me to sign for the cash as proof that I have received it, NOT to authorise its issue. The "squiggle" I put on the receipt looks nothing at all like my actual signature, apart from which, by the time I sign, my card has been returned and it is back in my wallet.

We also keep ours (Amex and the older cards still don't all have chip and pin) but ours are kept out of the public eye. This was just a list that was left behind the till... there was one for each of the 3 tills, even tho only one was manned, anyone could have picked it up. Still, no harm done

You are signing to say that you have received your cashback. It is their (not very good) form of back up, to stop you pocketing your cashback and going back into store an hour later and saying that the cashier didn't give you your money.

Our local Kwiksave used to do a similar thing (before it changed to somerfield) whereby they would get you to sign or initial their bit of receipt that the till spits out to say you had received your cashback. My gripe with that was they would get you to sign before actually giving you the cash, I had many a standoff where I would refuse to sign/initial before I had received my money.
