Mother died and now accused of fraud what can we do?

One thing that springs to mind with the increase is 25% tax. Not saying I am right but it's a thought.
What year did it go up? Was tax being taken at 25% and then stopped? If they stopped taking tax then HMRC may have told them via a coding or letter. Whose coding was it - surely not your Dads as he had died? If they used your Mums coding then they were paying it to your Mum I L in full knowledge. Have any year end tax forms (P60s) been found? Could a guaranteed annuity have remained payable and the tax status changed when your FIL died? Lots of rhetorical questions there....just following on from the thought as to why there may have been the particular increase there was.
My calculations behind the 25% :
Gross 200. Tax 25% is 50. Net after 25% 150.0 -

I found out the other day that my MIL still has most of her bills in deceased (6yrs) FIL name and anything that comes addressed to him she puts in 'his' drawer... I have now told her she needs to sort this out big time.. one thing I did make sure of is that the Pension providers were sent a copy of the death certificate.. when I asked her why she hadn't changed anything she said , I don't know how.... and neither of her offspring had bothered to enquire...#6 of the SKI-ers Club :j

Aww, I don't think you're thick at all. Any abbreviation seems obvious once it's explained, but isn't necessarily obvious at all before that.MarkymarkD
Of course. Thanks for not posting how thick you think I am.

Tanith,
I hope our problem helps your MIL. That will be a small consolation to us to know we have helped prevent another person from being in a similar situation.
We sent copies of the death certificate to the pension company too. Check she has some kind of confirmation or correspondance which can prove you have done it. We will probably be spending most of Sunday going through all her papers and statements to look for this. Even if we find it we/she will still have to pay any extra money back so you should also chack that your MIL has had a reduction in her payments.
Good luck

Thanks for your good wishes that was the first thing I asked her if the pension payments were reduced after her husbands death and she did confirm it was, thank goodness, she needs to sort all the other stuff out though problem is her daughter although not willing or allowed to intervene takes offence if I step in so its a difficult situation, all I do is advise what she should be doing but I fear that is not enough...#6 of the SKI-ers Club :j

Good news.
Still no letter from the company but BIL found confirmation that she was entitled to full pension after FIL death. Now it is the legal bit of he said she said to deal with. Think the company may still want money on the grounds of breach of contract or something.
Wish that letter would arrive soon.

I'm finding it hard to see why there would be any amount due back to them, if the full pension was due to continue after the FIL's death. This sounds like good news and that the insurer don't know what they are up to.0

samja1, excellent news! That suggests that it might only be a month or two's pension paid in advance that has to be returned. That would be normal.0
