Letter of Grievance

Hi,

I haven't been paid for four months and I have been advised to write a letter of grievance to my employer. The company has been experiencing financial difficulties and I haven't had contact with them for a while, I am not sure whether I am still employed or not as I have not received any communication from them. These are the only grievances I have.

Does anyone have any tips or recommendations for things I should include in the letter?

    Does the company have a HR department you could call to ask them if you are employed and when you will be paid?

    Draft a rough letter and post it here for people's advice if you aren't able to speak to HR.
  • This is what I have so far. Can you please give me feedback on it. I'm worried I'm going to make the situation worse, not better. Please help.

    Letter of Grievance

    I am writing to formally raise a grievance in regards to my employment with {company name removed}. I am raising this grievance as I have not received any pay for working from 8/6/12 to the 25/10/12. I have calculated the amount I am owed as £1164.80, I have already deducted two weeks off the amount due to two weeks holiday I had in July.

    I am also writing to try and discover my current employment situation. I have not received any correspondence from you regarding my employment status; I would like you to clarify this position.

    I hereby give you 28 days after receiving this letter to resolve these issues by paying me in full the sum of £1164.80 and clarifying my employment status. If after 28 days these issues have not been resolved, I will seek legal advice and will begin legal proceedings.

    I would be inclined to try to resolve this informally and to speak to someone initially before writing a letter but I will leave it to someone with more knowledge and experience to respond and give you better advice.

    How do you mean you're not sure if you're employed or not? Do you go to work?
    Have you tried just calling them to find out what's going on - they might just be able to sort it on the phone?
  • I have spoken directly to the managing director of the company about the two points and he has not given straight answers. The lease on the office we were working out of ran out and the company had to leave and informed us that they were looking for new offices to rent, but since the company left the office my fellow employees and I have received no communication from the company.

    Do you have an address to send a letter of grievance?

    If you have tried to resolve the situation then you have nothing to lose by sending the letter and if they don't reply then see a solicitor but the fees may cost more? Again, I'm not an expert.
