Hello.. this is my first post on here but I have been lurking for a while.
My partner and I have debts of around £16,000 and are currently with the CCCS on a DMP. All was going well until my partner found himself out of work for a few weeks. As he is self employed, if he doesn't work he doesnt get paid. So whereas we say he is on x amount per week... that only applies if he is never ill/out of work/on bank holiday etc. If he needs or has to have a day off (as with the recent Easter Break) we are in a bad situation again - robbing Peter to pay Paul.
Anyway, one of our creditors has started being awkward with the DMP and has now gone through courts. I am petrified! The CCCS tell me not to worry but this is killing me!
The problem being that this particular creditor is our bank, but the loans section. My MIL has helped out a bit and bought my husband a car to get him to work (as the train cost was astronomical). That car was stolen and the insurance money also went through the bank account.
I am worried that the loan area have seen all this supposed 'money' going through our account and that is the reason they are wanting a CCJ. Can the loans area have access to my account??
The amount they suggested we pay was double the original figure and we could no way afford this! Whereas my husband is willing to fight this all the way (btw, we are also claiming bank charges from this bank too - hence (IMO) the sudden turn around in attitude).
This is making my childrens lives terrible. They constantly see their mother falling apart and this makes me feel worse and even more useless. I dont know how to get on top of it all.. I feel that I have tried everything but my hands are tied feeling this way, having children and having no money of my own! My Husband is great and is a very hard worker, but he doesnt seem to get stressed out at all by any of this and it all seems to land on my shoulders. I cant sleep, eat or do anything at the moment. As hubby says. "I am not functioning"

its essential that you open another bank account with a bank to whom you owe no money and get all your income paid into it.
your current bank can raid your current a/c to pay off the loan.
If they do in fact take you to court make sure your income and expenditure figures are realistic. so make sure you give your OH average earnings and not his peak earnings. you must be realistic as you have to live with the figure for several years.
in the end a CCJ is only a little worse than defaults but its essential that you go to court and make sure they have for full financial details.0 -

Clapton - Thank you for your words. My OH (other half??) is reluctant to change his bank account because he doesnt want to loose his debit card. I think he isn't going to have much choice. He has said to me today to sort out all the letters associated with this debt and he will sort it out. He hasn't seen any of the letters thus far and I have been trying to manage it myself, getting angry with him if he is sick or needs to take a day off work!
To top it all off, my car has been into the garage and needs over £300 worth of work! Now... the DMP didn't see that one coming either!!Alliance and Leicester Loan - 7,215.05
