Consortium Reclaim

My husband was coldcalled by this company and told that he could have his credit card debt "wiped off" as he should have been sent contracts everytime his credit limit was increased. He paid them over £1500 ( the amount was charged to his card)...he heard nothing for 3 months and then received a letter from Credit Clear Services Ltd confirming that he has a case and asking him for another £149 which would be the cost of sending his papers through to the barristers. After googling both names it would appear that this is just another scam and all he has ende up with is more debt.:(

I am not making any comment about this company as I dont know what happened between your husband and them. I dont want to make a potentially libellous post. However, I will describe the known scams that occur and you can make your own mind up.

You cannot get your credit card debt wiped off. Some companies thought they could be the OFT and high court made some rulings over 2 years ago which clarified the position. Most of the claims companies that took money on that basis failed and went into administration taking the up front payments with them. Those claims companies that survived ceased taking business in that area.

All you have left are dodgy companies who still cold call on that basis. The typical scam is that they tell you that you can get your debt wiped off. They sometimes, but not always, take money off you up front but typically come back after 3 months saying you have a case but they need more money from you to put your case through. It is a form of advance fee fraud.

    Some key points:
1 - your debt is not written off. It becomes unenforceable in a court but remains on your credit file but shows as defaulted. So, you destroy your ability to get credit for the good part of a decade.
2 - cold calling where there is the possibility of legal action is not allowed. Any solicitor taking on business on that basis can be fined or struck off.
    3 - read http://www.oft.gov.uk/news-and-updates/press/2010/105-10

The general rule of thumb is to never pay anything up front. If you have a good chance of success then they wont want up front money. If they do then its a good chance it is advance fee fraud.

blimey he was conned. paying £1500 to have debt wiped out is surely a contradiction in itself.

Also, I believe it is illegal (for you to agree) to place the fees for "wiping the debt of a CC" on the CC (or any other associated creditor account).
  • I hope this information will not only help me and my husband who gave money to them back in november last year. But will also help others.
Im just going to post the link I found and I would suggest people call them as I have been told today that Consortium reclaim have filed for voluntary liquidation.
I have just seen I cant post links as a newbie however if you do a google search for consortium reclaim and the mirror it will take you to their blog which is the link I was going to post with address and telephone details of the practioners.

The mirror have listed the liquidation practioners and there is a number you can call. I spoke to a very help man and he gave me advise on how to proceed with trying to get my money back.

    I hope this helps.

    Thank you
  • They're back!!! Please, please be careful people. A former incarnation of this company, Consortium Reclaim, took 2000 off me last year then disappeared. Just had a cold call from Claim Credit Service. The spiel is the same, the address is the same, even the "senior advisor" I spoke to on the phone is the same. Am reporting them to the MOJ now.
  • was contacted early june 2011 (cold called) got sucked in paid them £900.00 on credit card had no reply from them I chased them card not enforceable so then owed £5000 on card was told to pay min payment for each month thus debt grew finally got fed up contacted citizen advice and Swansea trading standards also my card provider trading standards very helpful wrote to card company used section 75 got money back so that was brief history.
so my question is company now in liquidation and my husband wants me to claim back from them the money paid and the £3000 we won from the card company (cause we done it ourselves) this money was never seen as went straight on card balance is there anything we can do?????
