Please Help Me- Robinson Way DCA

I have been receiving letters from Robinson Way regarding an alleged catalogue debt, I believed I cleared this off a number of years ago, Great Universal for £220.

So I wrote a letter requesting a signed consumer credit act from RW and today i got this reply and i don't know what to do now...i haven't admitted any debt because i believe i do not owe them a penny now, i did owe them about 4 years ago and paid off a debt of £86.


We refer to your recent communiciation requesting a signed agreement in relation to the above account.

As with most home shopping accounts you will not have signed a credit agreement. you are deemed to have agreed to the terms and conditions of the credit, which were relayed in thr catalogue itself, when you placed your first order.

by ordering goods from the catalogue, you are liable for the payment of those goods. if you are denying responsibility for the debt, we would ask what steps you have taken to return the goods you did not intend to pay for.


the debt remains outstanding and we require full payment by return.



What do i reply to them now, do i ask for proof of debt?

    Yes ask them for proof that the debt is yours. If they can't prove it's yours you shouldn't have to pay it.
    Did you keep any paperwork saying you paid it off before?

  • No but i have contacted great uni and they have said i don't owe anything and i have been waiting for a letter from them....

    now they (robinson way) are saying i owe £220 and i asked for a credit agreement and they can't produce it does that mean legaly it cannot be enforced against me?

    i want to write a reply today and i really don't know what to say

    my last letter was requesting the agreement and proof of debt and that is the reply.

    Write to them saying that you will not be paying the debt as it has already been paid to great universal, and that you are awaiting confirmation from them which you will forward onto them when you recieve it.

  • My OH had a similar situation with Robinson Way regarding a debt to Ebay. He contacted Ebay directly who said he didn't owe anything (he'd paid it off about a year before) and that they would tell Robinson Way to stop pursuing him. Robinson Way still kept at it though, so in the end OH got a letter from Ebay confirming his account was clear, and then he sent it to Robinson Way. We never heard from them again.

    So I'd recommend getting confirmation for the company in writing that you don't owe them anything, and send it to Robinson Way.
  • spoke to GU again this morning, they will fax RW directly as well today so hopefully a double whammy there.

    I also took the liberty of phoning my nearest Citizans advice board, i read the letter to the man on the phone and he was helpful, he advised me that this is just their way of saying they have no proof of debt and no cca to back it up either and them trying to get the money regardless. He told me that under the cca, a cca would have to be signed and dated and a copy sent to me detailing the apr rates and terms of payment, he said he was aware of them and they can be quite a bullying company and they always use the trick of not having the cca into trying to get people to pay.

    I was told to write back saying that the debt in unenforcable due to the absence and informing them mail order catalogues are not exempt from the cca like they seem to think.

    i did also speak to the county court too and asked how i would enforce a debt without a cca, they said i couldn't really but it would be up to the judge, so i have put in my letter that i would welcome their intention to take the matter further so they could be exposed as using underhand tactics to get people to pay up.

    i am so angry at them! but a bit relieved now too. Will post my letter later!
