bailiffchaser vs barclaycard

in september of last year i sent barclaycard a subject access request. I recieved the relevant statements etc from them and then i took them to court for £2100 approx of charges illegally levied on my account. i had a hearing date next week and today they phoned up and offered me to settle . Which i accepted in total they refunded 1750.00 and have confirmed that i can continue the claim for the other 350 ish pounds. anybody have a similar deal ?

  • I haven't approached CC companies to reclaim charges but am looking to do so as we have paid charges. Can I ask if you had already settled you CC account or if you had an existing balance - and if you did were you required to settle it.

    My worry is that I can't afford to clear the card debts (see signature!) and if I ask for the charges back is this likely to happen.

    Sorry to hijack your thread - but thought you may have some experience of this.

    Please supply me with a complete list of transactions and charges relating to my banking history with your organisation. Alternatively, a complete set of statements for that period will be acceptable.

    Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you.

    If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.

    I enclose the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties against me, then I shall be reclaiming them, and also reclaiming the enclosed £10 Data Protection Act subject access request fee.

    If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However, please note that the above address is the one which you normally use to communicate my private business to me and which you have hitherto found to be acceptable.

    Hi Bailiffchaser.....well done on success with Barclaycard.

    Can I ask if any of the charges were the £12 ones or were they from before the CC companies reduced the charges. I ask because all my charges occurred last year and are therefore at £12 (I think...but request in for confirmation via a copy of your excellent letter).

    I was just wondering if they refund the £12 charges or are just backing down from the days when they charged much higher penalties.
